I own legomindstorms.net, Lego corporation is asking it back. Should I give?

Hi,

I like to seek fellow Warrior's opinion if you've done domaining before.

One of the rules is not to mess with copyright names but it's just too irresistible not to buy legomindstorms.net when it's available. (Think of it as getting to buy www.Iphone5.net.)

Basically, Lego owns legomindstorms.com and right now, they would like to have www.legomindstorms.net (which owns by me).

Do you think I should just give it to them or ask for any negotiation, just like selling domain names to a buyer?

If any have done negotiation with similar situation like this, I would love to hear your input.

    There is a chance that they would pay for it rather than filing a lawsuit if appropriate. I suggest you do negotiate. In the end either if you did negotiate about potential purchase or not the chances are that you will keep or lose it.

      Thanks for the feedback. The situation is, I don't know how to gage when it's "red alert" or how much it'll cost them if they were to engage a lawyer.

    I am not a lawyer and do not pretend to be one on the Internet: but.....trademark law isn't that obscure.

    If legomindstorms is a trademark, you are treading on some turbulent waters. It's called cybersquatting. You can't use it if they claimed a trademark before your purchase - well...ya can, but you can get slapped pretty hard for it. If they were using the name first, in a trademark suit, the favor will go to whoever had it in operation first and actively when the other was purchased. About your only shot with that thing is to see if they will pay for it. If they do great, if not, you are stuck with a dead domain. I am not sure whether or not they can force you to just hand it over if you don't have it in operation.

    Now that you know that -- ask a lawyer what your best option is.

    Because this is a .net domain name and controlled by verisign, they can go through a court order to force the domain name over without any of your involvement. They are trying to make it easy on themselves, but they already had you contacted by a lawyer. I am sure they are going to start the process if you say no. They are also seeing how you will respond. I just do not see how you can win because of the domain name being controlled by verisign.

    I do not know what treaties with regards to law enforcement the United States has with Malaysia, but since this is a .net domain, one way or another Lego will get their hands on the domain name. Also I think if you do ask for money for the domain name it will make their ability to get a court order easier. I would say as long as they do not go after any money you made off the domain name nor that they do are not threatening to brutally sue you, you should just had it over easily and ask them to handle any transfer costs.

    Thats basically how I view it, but I am not a lawyer.

    I can't see this mentality that you had here. You obviously knew beforehand you were wrong. That sounds just like you driving by my house, stopping and throwing up a camper trailer beside my lovely creekbank and saying I just couldn't resist. Well, it was against the law in the beginning, and you have already admitted that. IT is trespassing. Why is it hard to resist breaking the law?

    Contact your lawyer for definite answers, but I wouldn't push Lego on this, it could get ugly.
