My suggestion is an attorney familiar with Internet marketing issues. Myself, Bob Silber, or Mike Young can help you out.

Due to some shenanigans this last year make sure the "attorney" is a real attorney. I've seen fraudsters claiming they were attorneys. Law clerks. Someone who went to law school but never passed the bar.

If you cannot find their license to practice with a State Bar Association, or they cannot write a one-sentence letter on your behalf without committing a crime (the unauthorized practice of law) - move on.

Everyone prefers "free."

You can probably get by with that for a privacy policy - so long as it accurately states what you do with private information.

Depending on your website a TOS may be a different matter. There you have several goals: (1) be legally compliant with your disclosures, (2) create enforceable obstacles to anyone who would try to sue and take every penny you have ever earned, and (3) to give you leverage in the event you ever need to consider legal action against someone.

If done wrong your "free" terms could end up costing you a lot of money and sleepless nights.

the best place to get them is from a lawyer. It's better to invest a good amount of money than to look for a free option with the potential of getting the living crap sued out of you, and never being able to make money again.
