Can I get in trouble,if I take a photo(my own photo,not a copyright one) of famous brand thing (for example can of PEPSI),add some info(for example how much calories one can of PEPSI has) and post all that on my blog ???

    I think in context you prob should not post a close up pic of a pepsi can unless you are talking about the brand.

    But on the filp side if a pepsi can happens to be in a photo and you are not claiming affiliation it should be ok so long as the pic is not directly for commercial purposes. If not then i guess my facebook must be a lawsuit minefield

      I believe that is what he said -- he wants to discuss Pepsi specifically. He posted this question originally in the copywriting forum but that was the wrong place for it. So I'll repeat what I wrote there:

      I am not a lawyer so my advice is not legally binding and may be wrong. However, to the best of my knowledge, if one publishes a picture of a Pepsi can and then discusses Pepsi (i.e. mentioning specific details about the product, including how many calories are in it as the OP suggested he would) then this is editorializing and perfectly legal.

      The issues come in if you use it to promote a different product (i.e. Pepsi says XYZ alcoholic drink would be great with their product) or if you tell lies (i.e. Pepsi uses inferior ingredients or whatever). As was also pointed out there, the photo itself needs to be a royalty free photo or one he owns rights to.

      Again, not a lawyer so my advice is worth about as much as you paid for it, but this is as far as I know accurate.

    Even though its your own photo your potentially advertising the brand Pepsi without their consent so you may get in trouble, im not 100% though
