What to do - Need Warriors Advice on JV issue

Hi Warriors
I need some advice.
I recently JVed with another Warrior here on a flipping venture to broker some sites and manage the listings.
I asked many questions via email including payout details and the warrior agreed I would recieve 5%-10% of the total winning ammount.
This sounded like a good deal to me. I listed the site on my Flippa account, managed the listing and it sold for $7.5K

This was almost 3 weeks ago. The buyer of the site then did the escrow transaction with the Warrior. I have not heard any more from the Warrior since last week when he told me the transaction was complete.

I now have not recieved the 5% commission, not recieved my listing fees and upgrades fees and also there is a $375 outstanding success fee on my Flippa account that is due on the 13th May

I have not heard any more from the Warrior since Saturday after numberous emails and he is un contactable on skype.

What would you do?

    I'm not sure what I would do. And since it's already happened you probably don't want to hear what you should have done but I'll go there anyway. Since you set up escrow on this thing you should have had your share taken out via escrow and had them cut your check. That's what escrow is for. Same goes for the fees. They should have been held is escrow and disbursed as soon as the transaction was complete. I don't know how it was set up but if you have a written agreement with your JV partner (detailed email might even be enough) you might be able to show it to the escrow service and salvage something.

      I would do some research about the warrior. Do you have any domain names for the person? "Whois" his domains and grab all the contact info you can find, then call him on the phone, that will get his attention.

      If his domains are whois guarded then look at his domains and find any contact info on his sites. Find out who he's friends with and start contacting them too, he'll get the message when his friends start contacting him saying your clalling them up asking questions about him.

      Post a thread here with his WF name as the title, and ask him to contact you ASAP.

      There's some ideas.

        Your not allowed to name anyone you are having problems with on the forum. This is against the warrior forum rules.

        I have done some research he seems tp have a few jv offers. No bad feedback though. His domains whois are guarded.
        I see he has recently posted on the forum a few days ago so I will try posting a message here with his details. Hope mods won't delete it.

      Damn! I didn't know you could do this through Escrow is this new? I always do my transactions with Paypal on Flippa as I don't normally sell sites of such high value.
      Do you think I can still contact escrow with the details?

        I have no idea what your part in this was. You mention you were supposed to get 5 - 10 percent. Which is it? What were you supposed to do to get it? That stuff all needs to be spelled out in an agreement and presented to escrow when it's opened.

        You might try contacting them but if the check has been cut to your partner it's likely to be too late. Again, you haven't given enough details. Maybe you need to chalk this up to experience. I'd start bearing down a bit more on the JV guy though. Maybe he's got a legit reason for not communicating with you.

    Flippa have now taken the $375 directly from my account! I am now in minus!
    Still nothing from the Warrior since his last email on Friday!

    He now owes me
    $375 Success Fee
    $74 Flippa Fees
    Plus 5% of auction which sold for $7.5K

    I am very unhappy!

    Warrior Support told me there was nothing they could do just be patient for him to come online.
    He has not been active on the forum since 30th April

    Help I don't know what to do!

        Yeah he responded to my email on Friday saying he had a virus but that was last I heard and Flippa automatically took the success fee from my Paypal last night.

        Really appreciate your help

    You will find that most people on this forum are honest and honor their joint agreements. I couldn't sleep if I didn't honor the agreement and it's not fair that your liable for all the flipping fees.

      Thanks for your comment. I think its totally out of order and feel like a mug now for agreeing to this.
      I don't know what to do now. Have emailed the buyer of the site to ask if the transaction was completed if not I guess I can dispute it through Flippa but then am I at risk of the buyer getting in trouble?

      That is definitely unjust. He should honor your agreement as soon as he is able to. If he has problems with his PC or ISP he should be able to get some other possible ways to contact you.

        Agreed! I have his Skype too which he never uses.
        He could always go to an internet cafe to email if he can't use the PC in his office or house.
        'Plus what IM marketer doesn't have access to email on their mobiles these days.

    Are the two of you from the USA? You're at the point where you need to at least threaten legal action against him. If a PayPal payment was made by the buyer, he SHOULD have access to the seller's address and possibly name. Ask the buyer for this information.

    Keep all e-mail transactions between the two of you and get any proof you can that the guy who you worked with had previous ownership of the website.

      Hi Mike,
      I am not from the US. But I think the Warrior who I partnered with is. The transaction was made through Escrow not Paypal. Will the buyer have his details? The buyer is from Canada.
      I have kept all emails to and from the Warrior.

    Hi,

    I checked my escrow.com account and e-mails to see what information was shared during transactions. Unfortunately, the most I get is the other party's full name. Do you have this already? If so, you may be able to begin tracking the guy down with this information if the name is unique enough.

    Unfortunately, since you are not a USA citizen, taking the seller to small claims court is likely out of the question (although, I am not a lawyer, so I don't know for sure).

    He has scammed me and scammed someone through Flippa.

    I listed an auction for him and it sold for $7.5K
    Buyer paid him direct through Escrow.

    I had to pay listing fees and success fee and was promised 5% of winning fee after escrow processed.

    Now I hear nothing from this seller!!!
    Its been a week and no reply

    He has scammed the buyer for $7.5K

    Scammed me for $375 plus $74 listing fee
    Plus 3 days of my time managing the auction
    Plus my Flippa account

    Plus I lost the 5% he was supposed to give me!!!

    This warrior should be banned and not allowed to list any JVs or sell anything on this forum!!!

    If anyone has worked with him and has a phone number or any details I cannot find anything but an email adress for him please help

    sorry to hear that this happened to you, you may not want to hear this if your the one who did the listing you should have been the one to receive the funds first and then give him his portion of the money afterwards. because your the one who has more to lose.
