SWReg refusing to pay me?

I was using SWReg as a payment processor for a membership site I was running. We did about $3000 in sales and then they closed our shop and gave no reason. They said I would be able to get the money in 180 days minus any chargebacks...

Well 180 days has passed, and they refuse to pay me.. what to do?

    This part seems to say that if they believe that it could be, etc...seems like a licence to keep your money if they feel like it.

    Paypal has done this to people in the past, too.

        After 180 days there can be no possible reason for them to expect additional chargebacks. I think they need a letter from your attorney threatening either criminal prosecution or civil action. (your attorney should know which)

        This is assuming you weren't doing something really wrong.

          Several months ago there was a similar thread about PayPal. The person concerned was advised to refer everything to the banking commission/department of banking for his state. I believe he did this, and the issue was quickly resolved.

            It is always a good idea to read the affiliate network or merchant's terms of service before deciding to promote their offers.

            That is what you should be reviewing in detail.

            Looking at SWeg's policy, it does not say they can just keep your money. It says they can keep a reasonable amount for a reasonable period of time to cover and losses.

            The ultimate question, of course, is what the OP was doing to generate the $3k in commissions.

            If it was fraud then presumably customers have been refunded, merchants repaid, and there is nothing left for an affiliate commission.

            If it was not fraud, or if customers have not been refunded, merchants repaid, etc., then maybe commissions are owed.

            Has a demand for payment or a further explanation been made?

            Looking at the TOS it says any disputes will be in Minnesota. It may be worthwhile to contact an attorney in Minnesota. $3k is not much in comparison to possible legal fees, but the issue could be simple, or perhaps on a contingency, or maybe the possibility of recovering punitive damages, or maybe the TOS allows recovery of attorney fees in Minnesota - any of which might be enticing to a lawyer.
