Domain Flipping Mishap?

Background info:

Well, let's just say I got my hands on an incredible domain. It is a rather large (and I mean big) company but has the Canada (.ca) domain extension. But either way I've done my research and it could be worth some serious cash.

My whole ideal problem / point of this thread:

Will I get in trouble if I try selling this domain? I mean I don't really have an intention to create a website out of the name or anything like that. Most I want to do is sell it.

Though, what do you guys recommend? Should I just contact that company and try selling it to them?

    Do they have it trademarked?

    You are more likely safer to let them come to you first. Monetize and use the domain/site but not infringing on their copyrights.

    Also I'm not a lawyer and the best advice is to ask one regarding this situation before doing anything.

      Yes they have it trademarked (the company name not the domain). I guess I'll just park the domain? I really just wanted to flip it on Flippa for quick cash.

        Trademark protection generally extends to domain names, but does depend somewhat on the form of the name and your usage.

        Be careful. Be very careful. As uneducated as you seem to be on the matter, you most likely are going to get yourself in trouble.

          Well, fortunately as well as unfortunately I had to let the domain go. Thanks for the advice, I didn't want to deal with anything too major.

    Flippa is no longer allowing trademarked domains. You could prove their case of "bad faith registration" in a UDRP against you if you attempt to sell it to them. They could also just opt to sue you.

    Definitely a bad idea to park the domain, as any parking company's software is likely to generate ads relevant to the Trademark owners products and or services. This is almost always enough evidence to prove a case of Bad Faith during a WIPO or UDRP.

    It might not be a bad idea that you let this go, however, if you didn't purchase it in Bad Faith and if you never used in such a way, it would be far more difficult for a company to prove otherwise.

    I am not a lawyer, but if you are looking to resell based on the fact that they own a country code extension, it seems to be a way to profit of a TM issue. Doesn't seem good faith to me. Be careful and make sure they don't try to engage you in a UDRP. A three member panel will cost you an arm and a leg.
