What would you do if someone was blatantly ripping off your site content and reselling it?

Hey Warriors!

I found something disturbing today...

Someone is ripping off one of my membership sites
and WSO's...

It's not just something similar, but literally someone
copying all my ideas and even using my template
layout for their own membership...as well as the
content I sell.

What would you do in a case like this?

      Basically what happened is they downloaded
      my templates and then put their own graphics
      on it...

      Made the name of the site very similar...

      Similar WSO title...

      You can even see at the top of the index page
      where they erased and put their name in...

      Does it look exactly like mine? NO...but you
      can tell they used all my design.

              I wouldn't have cared if this person
              would have just used his own style
              and his content was different...

              I mean look at Wal-Mart...

              All businesses do it, but you have to
              have your own style..

              I think when you steal ideas and copy
              this blatant, it makes you look like you
              can't think for yourself or come up with
              your own ideas...

              I won't dwell on this too long...

              Just want to get it off my chest, then move on..

      Purposely put your links in. I used to get a lot of work copied from my newsletter but I went and put in essential links that re-directed to another part of my website which meant that anyone who copied my content had to send people back to my site which meant an increase in visitors.

      I actually just contacted one of my best friends
      who's brother is a copyright attorney :~)

      He looked at both sites and the content for sale
      and he think I would have a case...

      He said he's almost certain it could be a copyright
      infringment case...

      As long as I can show the age of my domain is older
      that his, I can move forward with this.

    All you need to do is file a DMCA takedown notice with their hosting company. You will need to provide proof that you are the copyright holder. They are required to take down the offending hosting account within 24 hours of receipt.

    It has been my experience that this is the best route. YOu then get to negotiate damages, etc with the offender and come to an amicable agreement before you release your claim to the hosting company. In other words he is down until you say OK>

    I have stopped many poachers this way. eBay is a little different but just follow thier steps.

    I defienitely recommend going the DMCA route rather than using an attorney. Most hosts will respond IMMEDIATELY when there is a valid DMCA sent to them and if not...well it means they are on teh hook legally for the copyright infringement as well.

    DMCA the guy/gal and then look at what damage it has caused you int he long run before you think about suing them.

    yeah man. screw lawyers...go the DCMA route.

    Besides, any attorney will say that you have a case. Because win or lose...you STILL gotta pay him/her for their time.

    Unless they're dumb enough to have left their name or email address on the site or in the Whois record, don't even bother attempting to go through legitimate channels because you'll just waste time, energy, and possibly money.

    If you want to be vindictive, and don't mind skirting the law, go to hackforums.net and ask to hire a botnet to DDOS their site. You'll generally get a reply in 48 hours.

    Since you haven't named the sites etc. it's impossible for us to determine the actual situation, but is there a chance that you've come to the wrong conclusion and it's just someone doing the same thing as you but with different content? I often spend ages putting a project together and then see someone else doing almost exactly the same thing - that's life.

    When it comes to IM, almost everything gets copied as soon as it hits the streets.

    Whatever the situation just make sure you're not jumping to conclusions and don't let a negative mindset stop you from getting on with positively improving you're own business.

    In cases where people have copied others, they're usually not actually making any money from their copied version and people sometimes go to great lengths to take offense and assume they're losing money to the copycat - but it's often not the case at all.

    Just don't dwell on it so long that it gets in the way of your business.

    I feel better about the situation now...

    I knew once I heard some input and talked about it a little
    bit, it would make me feel better...and it has.

    It's so frustrating when that happens to you
    and you're so darn busy with business you
    can't just waste time in some hassle...

    I've had people rip my copy directly.
    Not just swipe and tweak... I mean
    friggin COPY and PASTE!! LOL


    Losers...

    Then they replicated it and sold it
    to others... LOL

    This happens to any good business. You just have to be one step ahead. Guys like Eban Pagean, Ryan Deiss, and Frank Kern talk about having this happen. They say that the copiers always drop off the map after a while because they don't know the model inside and out and innovate like they do...

    I had that happen to me too. Just found out a couple of days ago by looking at my traffic stats and went back to the refering url and found that they ripped off my pitch page, stole my product and are selling it at a discounted price on eBay. They have a page on free webs, a free hosting site anyone can use to make a web page. I contacted webs.com abuse department requesting it to take that page down. Their response was (in reference with my url that I told them where the original content was stolen from) - the url does not exist on our site. I wrote back saying "read the e-mail; this is MY url, and the url in violation is so and so". I haven't heard back since. It's been what 24 hours or so. I am going to go DMCA route. The problem is it is unclear whom to contact because webs.com have their own servers they host the site on.
