Copyright Infringement at mybookez.com

Hi all,

I'm after some advice.

Two weeks ago I discovered (courtesy of Google alerts) that one of my ebooks I sell for $37 is available for free on mybookez.com

Long story short...

I've contacted them twice using their contact details on the site and have had no response or acknowledgement from them.

A 'Whois' search wasn't much use either.

Has your copyrighted material appeared for free on a site? If so how did you get it removed?

Should I even worry about it?

All thoughts gratefully received.

Kindest regards

Marcus

I had a lot of success with DMCA.

I also got a couple of sites taken offline by contacting the hosting companies.

You should always be able to find out who hosts a site. Sometimes it takes a bit of digging though. Try a reverse IP lookup and you might find who else is hosted there.

I would look up their host (usually simple - just go to who-hosts.com) and serve a DMCA notice on them by email, sending copies of that email to "admin", "info" and "support" at the site-domain.

If it's a US host, that will almost certainly work. Even if it isn't, if it's a reputable host it'll probably work. If it's an unethical and/or stupid host in a strange country, it probably won't.

I don't know. I would worry about it.

On no account listen to people telling you that you're not losing anything "because people who take illicit free downloads were never going to be paying customers anyway". Unfortunately that isn't true at all. The world is full of people who, when they want to download something, will look around for a "free copy" of it first from a black-hat/torrent/file-sharing site or anywhere else, and then buy it only if they can't find one. :p

    Good luck, Marcus.

And when you send those copies, make them a plain, out in the open CC: so the hosting company knows you sent the notice to the site. Totally eliminates any "nobody ever told me it was copyrighted" excuse.

Do the above. File a DMCA with their host. Works for me most of the time and sometimes even when the host is not in the US.

This company will help you: DMCA Protection & Takedown Services (NO affiliate link).

A friend of mine went through all the standard DMCA procedures trying to get some content removed, but was unsuccessful. This website got it sorted in just a couple of weeks.

Turns out mybookez.com is hosted by monikerdns.net but when you type in monikerdns.net you get:

"opps google chrome cannot find monikerdns.net

How can a site be hosted by site that doesn't exist?

I really don't want to pay $199 unless I absolutely have to.

    Any thoughts?

    Thanks again for your help.

Yeah, I did that and this was the reply I got that I really didn't understand. Can anyone shed any light on this?

        Hello Marcus,

        Thank you for contacting Moniker.com.

Please be aware that this domain name is registered by a customer of Moniker Online Services. Moniker.com is not the owner or the host of this domain.

The registrant has elected to use a privacy shield for this registration. If you believe the registrant has violated your rights with this registration, you need to obtain an appropriate finding by a court of competent jurisdiction or file a UDRP complaint against the registrant. The domain owner can be contacted by using the address listed in the publicly available whois which can be located at:

        https://www.moniker.com/whoisdomain.jsp

As a courtesy, we have also provided links to the tools that will help you locate the correct host to contact.

Traceroute, Ping, Domain Name Server (DNS) Lookup, WHOIS can be used to perform an nslookup. This will show you the IP address of the host for this domain. Use the 'DNS lookup' and note the IPs used for the zone record.

You can then use the IP whois on http://www.arin.net (top right) to locate the network hosting those IPs.

        Thank you,

        Moniker Abuse Department
        Thanks in advance

          Yes.

They're telling you that they're the registrar but not the host. One of their clients bought it through them and took privacy protection with it.

You need to serve the DMCA notice on the host. Have you tried looking this up from the sites they suggest (domain-tools and arin.net)?

Can't find the host. who-hosts just shows monikerdns.net, so moniker is blocking that information through it's privacy service.

Hmmm ... then I don't understand (always likely ). They say "we have also provided links to the tools that will help you locate the correct host to contact" and give links to domain-tools.com and arin.net - what's that about?

Using some of those tools, everything seems to go to moniker

They're treating it as a trademark infringement rather than copyright infringement, so it looks like that's a dead end. They have privacy service on the domain through Moniker. Your best bet is to attempt to contact them through the privacy email provided in whois and then use the Google tool to send the DMCA to Google so they'll delist them.

    Suzanne, you rule!

I've been looking for a suitable DMCA takedown notice, but they all seem to relate to copied text. My problem is a copied book.

Do you think it would be okay to modify the one here (at the bottom of the page)?

Yes, use that one and just modify it to say ebook. Make sure you give your details of your ebook, the publication date, the page where you offer it, etc. and the page where they offer yours
