Logo Usage in a Product Review

INTERNET MARKETING

According to the law it should be OK to include the company's logo in a product review or comparison table. But what are your experiences on this? Sometimes they state on their websites that any use should be approved first (even though the so called fair use exists). Have you ever encountered any problems with using logos in this context?

EDIT Just checked on a lawyers' site, and it appears that logo usage on a review website may not be considered fair use (because a review can very well exist without the corresponding logo).

I assumed this based on Wikipedia logo guideline. This states:

It is believed that the use of low-resolution images on the English-language Wikipedia, hosted on servers in the United States by the non-profit Wikimedia Foundation, of logos for certain uses involving identification and critical commentary may qualify as fair use under United States copyright law.

On the lawyers' site they tell that it may or may not be regared as fair use, and you may have to defend yourself in court. Well.. I have no desire to do anything of the kind, so I better go with "better safe than sorry".

Check with the company itself, that's safest

If it's trademarked, they do have the right to request your removal if they don't like it. Trademark does not automatically chase everyone away from using it, sometimes they will keep quiet and let you have it if it's for their interest. You can still ask for permission.

1. Don't take legal matters like this lightly.

2. Don't ask for legal advice on a public forum.

3. Don't take legal advice of a lawyers website because you have no idea who the lawyer is and how competent they are or are not.

In short, get proper legal advice or don't use the logo. If unsure, always assume you cannot do it until you have been told otherwise.
