Opening a PayPal Dispute - The correct way

Hi,

I have bought a product which has not been delivered, the product was website creation. Not sure if this is classed as a digital product or not? Anyway, the website was guaranteed within 30 days and its still not been delivered, the vendor is now unresponsive and a PP dispute seems the only way to move forward.

I am within the 45 day period to open a dispute.

I want to make sure though that I do this the right way. I know there are specific things to say and make clear, otherwise PayPal say that the purchase is not covered.

Can anyone tell me the correct procedure to ensure my dispute is in my favor?

    If you did not get your product as promised then something is wrong. Maybe it is sitting in your JUNK mail box so check that out.

    If you repeatedly emailed the vendor and they did not get back to you then I would open the dispute up through PayPal.

    My question was really if PP will cover the purchase. Is it classed as a Digital Product? I know PP have specific rules on what is covered for dispute or not.

    I want to make sure that I do it right.

      Once you log in to your PP account and open a dispute just state you never received the product. The vendor will have to provide proof that they did deliver the product to you.

      Also, PP customer service is great. Login to your account and there is a link to contact them. They will give you a PIN number and select the appropriate phone number and give them a call. I have never waited more than a few minutes to talk to someone and they can walk you through the whole process

      It is classified as a service and it still isn't covered, but I would file the dispute anyway and submit all documentation to Paypal such as communication about the project, promises in the sales page, etc.

    Isn´t there some rule though, that digital products are outside the scope of disputes?

      You can raise a dispute over a digital product and sometimes win, but it depends on how the seller handles it. Services are not covered and if your provider just states that it's a service, you will lose. Buying a website might be covered if worded correctly, but with this being hiring someone to build a site, you will most likely lose.

      That being said, it won't hurt to go ahead and open a dispute. Some sellers will refund just to close the dispute; some won't. You won't be out any more money so it doesn't hurt to try.

      Was this purchased through an ad here on the forum? If so, you should be posting in the thread and stating your experiences, especially if there was a guarantee in the ad. If they don't respond after that, go and report the incident to the Help Desk. Support can't get your money back but they will stop that seller from continuing to sell because the rules here say that a seller must honor any guarantee or refund policy that they list in their ad.
