Spam complaint rate questions

I have some questions and would like some feedback regarding spam complaint rates for an auto-responder email series.

I have an email campaign where I give away a free demo of my product, in return the subscriber gets put on my newsletter (an auto responder). Its a series of 25 messages that slowly gets to the final interval of every 8 days.

Here are some stats since November 15th - (I use GetResponse BTW)-

2733 subscribers (100% confirmed opt-in)
15378 emails sent
44.81% open rate
1.64% unsubscribe rate
.36% bounce rate
.25% spam rate (my main concern)

As you can see, my concern is the spam complaint rate. The industry maximum is .1% (2.5 times over the limit). Will GR drop the hammer on me?

There is still a long time to go before every subscriber gets to the final message, at which time I am hoping the spam complaint rate will go down further. I am not sure if I can get it below the .1% standard.

The good news is that over time the spam rate seems to be declining but I really dont know what to think. Most of the people on the list really seem to be engaged with the content but SPAM complainers really make me question giving away a free demo of my product.

1. Will GR drop the hammer on me?
2. Does it matter if they are ALL confirmed opt-in? They did click that link inside their email so maybe this negates all spam complaints?
3. Does anyone else want to share their spam complaint rates and/or experience?

I greatly appreciate anyone's feedback/help/comments. Thank you for your time.

The only way to find out who's saying your emails are spam is to send out an email and question there loyalty..If they don't want to be on your list they should unsubscribe..Better to have a good responsive list than a large unresponsive list..

    Good Luck!!

It seems no matter what you do sometimes, you will get the spam complaints. Not really sure if GR will be doing anything on that percentage, though. I know sometimes on my broadcasts to my opt in list I'll get one every now and again, and aweber has never said anything to me about it..

    Ask them.

They're friendly and approachable. You can discuss it with them openly. Seriously, you'll get a much better and more relevant opinion that way than by asking randomly self-selected Warriors who happen to reply.

I'm pretty sure it won't "negate all spam complaints", but it may change GR's attitude a little, compared with how they'd feel if you were using single opt-in? I don't know. Again, it's a question for them.

Would it really help? Maybe, a little, if they're people using GR, and in the same niche as you, and gathering traffic in the same sort of ways and (most important of all) sending the same sort of emails at the same sort of intervals? Otherwise maybe not much, really?

Sorry to sound so unhelpful. I'm not trying to criticize you for asking here, at all. But I think it's easy to ask GR as well. I'm not a GR customer, but I know they're friendly and approachable and sensible ... "just saying"!

Another observation: it may go down well with them if you approach them to discuss it, saying that you're concerned about your spam-complaint rates. They might like that, and instinctively be on your side more than they would be if they have to "approach" you?

    Another Question,

What usually happens if the GR [or Aweber or any other one] get annoyed with owner of the list because of spam rate?
