I wanted to check if any of you are aware of any lawsuits/litigation/cease&desists regarding PLR content?

Specifically, PLR does not allow you to give away the content for free*. You can offer it as a free bonus to a paid product, but you cannot just give it away for free.

My question is has anyone heard of anybody giving it away for free and being sued or called out on it? I'm curious because logistically its hard to even know whats original content anymore and how many iterations the PLR you buy has already been through. Technically speaking, the chain of custody on this stuff seems non existent.

*I know some PLR license rights may be "giveaway" but I'm referring the "normal" PLR license terms.

    While I am not a lawyer, I would simply use the content in the manner outlined by the original creator.

    If your concerns of 'giving it away' as a 'freebie' for list building purposes, which I have a sneaking suspicion that's what you're wanting to do, simply rewrite, repackage the content, and make it your own.

    Though I rarely use PLR myself, outside of a base foundation on topics I lack knowledge of, I would avoid all legal concerns and just rewrite, and repackage it, after all it's probably smeared all over the internet already anyway... breathe some new life into it! -Preferrably, make it better, whereby, it delivers value to the whole.

      Hi Art - thanks for the input. Believe it or not, I wasn't asking out of a desire to actually give PLR away for free. I was really interested in knowing if a PLR license has ever been attempted to be enforced, as I believe it presents some interesting legal challenges.

    Art is spot on. Just re-write PLR and make it your own.

    PLR is an easy way to get an outline for what you want
    to do, so just recreate it.. make it better and you won't
    have to worry about it being someone else's any longer.

      This is super helpful, thank you! I am both looking at editing some PLR now and also about selling PLR to my own original content. Is there any reason one would not want to sell the PLR to their Ebook? Any downsides that you know of?

    There is no 'set in stone' standard for PLR. It's all different according to the terms stated in license by the product creator or owner. There are plenty of PLR products that can be given away.

    I supply lots of PLR that I create myself.

    If someone is breaking my terms I email them and let them know. That is all that has ever been required. Your reputation is everything so most people don't do it on purpose.

    I usually find out pretty quick if someone is abusing the rights because my members let me know.

    Lawsuit? No way. Maybe if I was a gillioonaire.

    By the way - PLR only means you can brand it. That's it. You can combine with any oter rights and make it transferable or non transferable.

    What happens when somebody doesn't abide by the terms of the PLR license? Well, that depends on the PLR Content Provider.

    Whether they ignore it or take action will depend on the PLR content provider. But, I'm guessing that the most likely action would probably to notify the person that they are using the PLR content in a way that's not allowed and convince them to stop.

    But the issue is not how likely is it for a PLR content provider to take action. The issue here is that the PLR content provider is in a position to act, because the person is using the PLR content in a way that's against the terms of the PLR license.

    If someone wants to use PLR content in a certain way, then they should only use PLR content that has a license that allows them to use it in that way. Basically, stick to the terms of the license. If you can't stick to the license, then don't use the content.

    It is always a good idea to rewrite PLR, or more to the point, get someone to rewrite it. Then its yours. I usually get a few PLR reports and get someone to make one at of the bunch. Then you can do whatever you want with them!

    I still don't understand why anyone would want to buy or even use PLR? It's content that isn't unique at all. If you rewrite it, why not just write an article from scratch in the first place versus rewriting someone else's article that there are probably thousands of versions of?

      I question whether most PLR licenses as typically presented/delivered are even enforceable.

      However, much as contracts largely keep honest people honest, most PLR licenses keep legit licensees in line with the product creators intentions for distribution

    As a PLR Store owner, I do actually know the answers to these questions. First Private Label Rights, Master Resale Rights, or Resale Rights are Industry terms for licenses that Information product creators use for licensing their copyrightable content. The product creators are granting you a copyright license that has a set of rights that lets you know what you can and can't do with their copyrightable product.

    For example, a PLR license generally gives you the right to take the content and rebrand it and resell it as your own. Many PLR licenses also give you the right to resell the PLR product with transferrable PLR rights. Sometimes the product creator will include this in what is called a Master Resale Rights license.

    A Master Resale Rights license will let generally let you use that content how you want and then give you the right to sell that same product to others with Resell Rights.

    Once you fnd a PLR product you like, you just need to check what the terms are of the PLR license for that product.

    I have not heard of any lawsuits specifically referring to PLR rights but these types of lawsuits would be Copyright lawsuits and would be filed in Federal court. Most product creators who find someone using their content outside the terms of the license, typically just email that person and that person usually complies.

    Like I always say, PLR is a great way to get started with a product or report. Many people like to get something that is fairly complete and then you can easily add some more valuble material to the PLR product and add a new graphics cover for $5 from an outsourcer from Fiver.com. It does not take that much effort and then you can have a product that is customized with your site, company, and twist on the niche.

      Most private label issues arise from the real meaning of PLR. Business A creates a product and Business B is able to put their name on it.

      For example: manufacturer creates a product and is shows up at Store A as Brand A and Store B as Brand B.

      There may be issues about where the product can be sold, royalty payments, verifying sales, extending the license, adding new products, confidentiality, exclusivity, allocation of legal risks, etc.

      PLR in the IM Niche is often an ungovernable free-for-all where the product creator is essentially giving their product away, especially if they provide it in a format which can be modified or "master" resell rights are provided.
