WSO ebooks about Paypal Tips? Have these authors need/had copyright permission from Paypal ?

I have seen some paypal WSO ebook reports, which show you ways to prevent your paypal account being shut.

Have these authors had legal clearance from paypal to write about the company?

or anybody can write a report about paypal/ 2co/ 1shoppingcart?
without any legal clearance ?

    Generally speaking, you can write about whatever you like unless you have made a contract (like to protect a trade secret) not to.

    The issues that tend to come up in these situations, are use of trademarks (you can't pretend to be associated with the company, or give the impression that you are), copyright (do you have permission to copy content or screenshots?), and defamation (writing some untrue slur about the company).

    Of course a company might sue you even if you haven't done anything wrong if they don't like what you've written or are doing.

    Likewise a company might not care even if you have made a minor transgression.

    Depends on the company...

    (i am not a lawyer, so this is just my layman's opinion)

    Some companies have strict guidelines about how to stay on their good side.

    For example, Microsoft use to have a page (haven't checked lately), that explained how and when you can use screenshots and how to refer to certain products.

    For example, they may say that you MUST write "Microsoft Office Professional Version 10 for Windows" the first time it's referenced and then later you can just say Office.

    There is always the possibility of trademark issues and copyright issues and as a rule of thumb whenever a person has a question in the legal arena, consulting with an attorney is the best bet.

    I don't see why you would need any clearance.

    They are not claiming to be Paypal they are simply offering their own advice.

    Just like I might create a video showing people the best ways to use their Adsense account.

      Like I mentioned in my post and explained in the link I provided, you DO need clearance to stay on their good side.

        Waste of time. You are allowed to take a screenshot of a website you are using if you want to. I'd like to see anyone stop me do that. I guess if screenshots of websites were illegal then the Google search engine would be in a huge legal battle right now.

        Trademarks and logos, different story. But unless you are using their name in a way that would lead consumers to be confused between you and the main brand, I don't see any issues arising at all.

        Thus why the website paypalsucks.com has been allowed to run for years and years.

        I am not a lawyer. This is my view.

        I think there are two separate issues here.

        1. The use of trade marks, logos etc.

        These are most certainly covered by legal and almost certainly company specific terms of use. When using those you will need to be sure exactly what you are doing.

        2. Offering "advice" on what "to do"/"not to do" to keep your accounts in good standing.

        If you are simply explaining exactly what Paypal (or other) have already quoted in public documents then you are unlikely to fall foul of the companies.

        If you are offering some method to "avoid" broken terms and conditions from being identified (like cloaking or multiple accounts) then you may well find yourself with problem.

  • The only folks that could give you a real answer to your question are those who work for Paypals legal department. Every other answer will be a general one based on assumptions and personal views. Even if you received an answer from a lawyer member of the warrior forum, they are still not PayPal lawyers. An educated guess based on some of the eBooks I have seen on similar topics, would be that the author of the publication you mention has not received any type of "legal" clearance".

      That's exactly what you get when you ask questions on open forum. People's personal views. You do not get legal advice (even when given by a lawyer I'd guess). Or at least not the kind of legal advice you can take to court.

        You are right! And as you mentioned in your post, there are separate issues including trademarks, logos, offering advice, etc. I can think of so many other issues that could come back to bite you when creating such products such as the fact that if your entire eBook is based around "preventing someones paypal account from being shut down", then what happens if thousands of people buy your book and then based on following your advice, all their accounts are shut down? I doubt that a disclaimer in your product is going to protect you from the wrath of a thousand nasty emails sent to you, not to mention the possible lawsuits.

          If people had to consult the legal department of any entity they chose to write about, every newspaper, TV station, radio station and blog would shut down.

          The AP Stylebook has an excellent section on the legalities of writing.

          You really don't need a weatherman to tell which way the wind blows.

          In my business I deal with "legal" frequently. Music and info products such as ours go through a rigorous clearance process that many internet marketers and their IM products, simply write off, take a risk on, launch their product, and hope for the best. Many don't get caught simply because their product does not create enough buzz to alert copyright holders. Those that do end up having a product that creates a buzz, (but contains copyrighted material) usually later end up in court. So yes, what if the sky falls...well at times it does.

      As mentioned, Paypal lawyers would be the ones that could give a real answer, as they would be the folks recommending whether to take a matter to court, or not. So yes, Legal opinion / advice / assumption / answer.... / same thing. In the end I guess if a case ever made it to court, it would be up to a "Judge" to decide. But now were are getting to deep.
