Adam Holland Lawsuit: Family Of Man With Down Syndrome Sue For $18 Million After Photo Sparks Meme

I've always wondered if this would happen with some of these memes floating around.

However, it doesn't mean they'll succeed in getting any money.

But I'm pretty sure you wouldn't want to be getting a letter in the mail asking for $6 million in damages just for one image.

They are suing 3 parties, asking $6 million from each.

I would suggest, if it's not your photo or you don't have rights to use it, just don't use it.

    Yeah this is a shame. Poor kid, this is bullying to the next level. Hope he gets at least one of those 6 million dollar bills.

    Somehow I doubt they will get any money.

    Nobody has the right to not have their feelings hurt. And I doubt the editing of the picture qualifies as any form of libel or copyright infringement.

      Regardless, the defendants will have to defend themselves and that means money.

      Imagine yourself in that situation. The time and money wasted defending yourself would be bad enough.

    I don't think anything will come of it, just due to the nature of memes and how fast they spread virally.

    For example, a meme images could possibly have hundreds of thousands of images out there, each with a different saying. These images are made by thousands of people and hosted on thousands of different domains. Which person out of the thousands do you file the suit against?

    Also, wasn't the image taken from the public domain?

      It's true, in reality, it's probably unlikely you'll get sued for a meme.

      In fact, in some cases, if you alter an image or likeness enough it's fair use and allowed, like the guy who made the Obama Hope poster and it became a popular image during Obama's first campaign. That's what I remember reading about that image, anyway.

      What do you mean by public domain? A true public domain image would be one that clearly is able to be used by anyone for almost any purpose. It would mean all intellectual property rights to that photo are nil, either due to it being really old or the owner expressly giving up all rights to it. I really don't think that's the case with this image.

    But the same thing could happen to you if you're like most IMers who simply steal images from Google pictures by typing a relevant keyword to then use it on their blog post...

      There are people who have been on the wrong end of Getty's lawyers. Even people who were completely innocent as they had the legal rights to use the picture as they had bought it from Getty in the first place. You don't want to mess with them as they are a real headache. I think they are way out of line with their aggressive tactics in some instances, and in the wrong sometimes for sure, but if you can keep out of the way of them when they are actually in the right, you will be happy.

    All of you people reading this have laughed at fat jokes, blonde jokes, sex jokes, racist jokes, most of you have probably even told them.

    Most of you have probably made memes or shared them.

    I dont think its got anything to do with that kid or his family. Who ever originally spawned that meme would have used an image of any kid.

    Don't try to get the moral high ground here people.

    Who hasn't laughed at the meme of the little chubby African kid dancing with phrases such as "Its Friday Lets Party..." ?

    So... what now? that's racist is it? is that making fun of homeless people is it...? No.

    Its having a laugh for the sake of having a laugh and you know what humans laugh at most? Other people and at other peoples expense. Its comedy 101.

    Where do we go next? not making cat memes, because its cruelty to animals, or because the animals feelings may have been hurt..

    Its a simple joke not intended to hurt anyone.

    I HAD a disabled older half brother. Then he died.

    His condition was not funny at all. I would have wanted to murder anyone that made fun of him.

    However I grew up making jokes about disabled people, why? Because its human to laugh and it's human to make people laugh using whatever material you have.

    Although medical condition, sex, race etc should not be made fun of, the fact is that your never going to stop it and some of it is actually funny.

    The family has not got a hope in hell in getting any money.

    If I saw a picture of me online with a meme wrapped around it, i'm not going to lie, i'd probably be upset at first... but then I'd get over it.... and then i'd probably try to monetize it myself

    The fact is that when most people make memes they will go to Google images, grab an image from anywhere and ka-blamo the meme is made. I think you will find this image was never posted on a meme generator website as a template.

    Is the condition funny, no.

    Are memes funny, yes.

    The family need to get over it or alternatively need to think about any time they ever laughed at someone else s expense.
