New FTC Regulations - Have you seen this?

Found some interesting information regarding updates to the FTC digital disclosure guidelines (March, 2013)

The summary is... they basically say that if you link to a product (or do a review or whatever), that you need disclosure text right there. Not on the bottom of the page, not after the post, not below the ad, not below the fold. Standard affiliate disclosure pages are no longer in compliance.

Anyone else seen this? How are you adjusting things, if at all?

While the report may be new, this interpretation is not.

In the FTC announcement made a couple years ago, the FTC said the exact same thing. People have already chosen to implement this or not.

All it takes is a lobbyist, $10,000 a plate to your favorite politician and this rule can be changed, better yet, take out a super pack

I find the wording of the PDF to be quite troubling.

Because it's basically saying the majority of blogs and sites out there are in direct violation of the FTC disclosure guidelines.

I went through and picked WSOs and random (about 5-8 of them) and, with the wording regarding placement of disclaimers in that PDF, it would seem that all of them were in direct violation of the FTC disclosure guidelines.

The way it's worded, I don't think one can even maintain 100% compliance without completely overloading their blog/site with multiple disclaimers per page.

I am not a lawyer, nor do I pretend to be one on the Internet...

But many people have said that if you can stay off of the FTC's radar, then you will likely be safe...

The FTC generally picks on the deep-pocket marketers and tries to influence a community by crushing a big-shot.

If the FTC continues to follow that policy, then it would only be a problem for someone when the FTC is ready to start piling on complaints against the person caught in the snare.

These are the people who are actually hiring lobbyist and contributing to campaigns, so they can scroll their terms in half a second in transparent text.

If some of these top marketers who makes millions every year, would spend a few thousand here and there, to help elect politicians, they wouldn't so tough on IMer's. The only people spending money to stop Imer's are big retailers.

This is how drug companies are allowed to sell pills with side effects that will kill you.

You must not watch to much T.V, there are plenty that have side effects like heart attack, stroke and even death.

It seems like suing for asbestos is a thing of the past, now all you see if lawyers asking " has a loved on suffered a stroke, heart attack or even death and was taking "_________ drug? "

I challenge you to find a drug, that doesn't have such devastating side effects.

Here is a commercial from a popular drug for anti-depressant Abilify

It's always good to have a politician in your pocket, that relaxes the laws, so you can make a fortune off such drugs. Now if a drug dealer from the street sells someone some drugs and he overdoses, the drug dealer can be charged with homicide.

I always get a kick from those commercials when I see them on TV...

            They always say...

Have YOU or a loved one died or gotten sick as a result of taking **** ?
Every single time, I mumble under my breath...

If I had died, I wouldn't be able to tell you about it!!

Lol, that is why they say "you or a loved one" just incase 'you" survived lol. They can't make any money from the dead, they want to make money off the next of kin lol

Well the Good I take out of it is that it does seem to make an allowance for linking to a disclosure page (like Google does) rather than having to put it right there next to the link. I think I am going to do mine exactly like Google.
