hey iam in the process of trying to get legit i see i have to get a dba how will i obtain that before i appy for my ein? any help i will be grateful i would start working from home and hopefully get a spot once i get bigger.

    you get your DBA (doing business as) at your local county clerks office. You have to choice a business name that is not being used and there should be a log book at the county clerks office with all the business names that are already taken for you to make sure your business name is available. It cost me like $20 when I got my DBA, but every state is different so it may cost you more. Once you get the form submitted at your county clerks office the will give you a notarized copy to have and to open a business checking bank account so you can now accept checks or write check using your business name, it's all really simple to do I got my DBA and opened my business checking bank account all in less than 2 hours.

      In Texas you can get your EIN from the local State Comptroller's Office using your DBA Certificate. No other incorporation or legal entity filings are needed.

    I don't see any benefit in doing it

      If you're dealing with true wholesalers and reselling on eBay, Amazon etc you will need a tax certificate...

      There are no tax implications at all. The EIN will still be reported on your personal income tax unless you are a corporation. If you are a sole proprietor, you can still get an EIN, and you file taxes with your personal return. A lot of sole proprietors get an EIN just so they don't have to give there social security numbers out....

        If you operate as a business and decide to get an LLC, you must file a separate return for the business itself (In California) whether you are a one man operation or have many working for you. I have had to deal with the issue first hand when questioned by Sacramento for having everything on one tax return.

        Also, if you don't have time to do the leg work yourself for a DBA, Legal Zoom can do your DBA online, but you will pay a little more for the convenience.

    An EIN is an Employer Identification Number, technically, any business with employees should get one, even if you are DBA, yet have no employees, there is no need for an EIN. If you are a US citizen, or Permanent Resident Alien, your Social Security # is all you need to do business Sans Employees.

      Visit your local city hall and fill out the forms. A DBA is primarily as a business registration with the city and state to enable you to open a business checking account and have various insurance policies to protect your entity.

      The EIN is for tax purposes if you plan to have employees, otherwise you may need only to have your soc sec number for a sole proprietor type business with no employees.

      That depends on who you're dealing. For example, some wholesalers and dropshippers want EINs before doing business with you.

    A DBA unlike an LLC or a Corporation IS NOT a separate legal entity, although a DBA can be used for a partnership, which may require a schedule K be filed with your tax return, whereas a sole proprietorship including a sole proprietorship that operates WITH an EIN is filed on your own Schedule C.

    An LLC is typically required to file its own tax return and will likely be treated as a disregarded entity UNLESS you elect to be taxed as an S or C Corporation, for a single owner, and a schedule C will be filed. If the LLC has 2 or more members, a schedule K will be filed. An S Corporation must file an 1120S, and a C Corporation must file an 1120. An S Corp is a pass through entity, i.e. you are taxed at your personal rate, and their is no tax on dividends distributed. A C Corp is taxed independent of the owners and dividends are also taxed on the owner's 1040 -the dreaded double taxation entity.

    Typically, any of these entities require filing out a page or two of forms to create, and MOST states offer simple fill in the blanks forms for DBAs, LLCs, and Corporations. Corporations are the most formal and will require by-laws to be drafted, while an LLC will require an operating agreement. Most of these entities can be established relatively simply and easily by anyone of average intelligence, with an ability to read a self-help legal book, or a fill in the blanks form. I would suggest the self-help book because there are some complications you should understand for yourself.

    Talking with a qualified accountant about the tax implications would be helpful, and I STRESS THE WORD QUALIFIED. Depending on where you are the quality of the professionals operating in the business law and tax fields can be quite mediocre.
