PLR Licence Confusion

Dear Warriors,

Maybe I am very careful here, but I do not want to step on anyone's copyright, even by mistake. I am having hard times understanding a licence here. To put every body into the picture, my website Buys audio PLR then convert them into Animated Videos ( I also offer this media conversion service for audio PLR owners). However since I do not create the audios, I am bound to the licencing agreement they come bundled with. So I was a little bit confused by the licence below regarding giveaways.

What I want to do, as I am still building my list, is to offer an audio transcript as an ebook along with its animated video, and as you can see below I cannot give away the audio ( only the audio ) within Internet Marketing niche. I wonder whether this restriction applies to the audio alone or does it extend to the video I create repackaged with it.

    [YES] You can give away the audios as an e-course within the niche that they were created for.
    You can give away the audios as long as it is in an e-course and in the niche it was created for. You can get around this by re-writing and re-record the audio. That is the only way I can see you doing what you want with the content.

    But what do I know anyway.

  • As I understand it, you want to create a video and give it away, by using an audio file of which the license says that you can not give away the audio. This means that you are then assuming that if you add video to the audio, that you are then entitled to give away your new creation. The safe answer is "don't do it", until you as Beverly suggested above, contact the owner. Unfortunately many PLR licenses created by internet marketers (especially when it comes to audio) are pure garbage and make no sense what so ever, and/or are incomplete as many of the license terms are left up to interpretation, as is the case here.

    Your best bet is to get in touch with the creator, unless you completely repackage and rework the entire plr you bought.

          Funny answer, but if I have chosen The PLR Novice for example, would that be better? I don't think so There are literally thousands of domain names and businesses with catchy names. The only things that separate us is the degree of integrity and honesty. I prefer to ask and get honest answers instead of pretending to know everything and step on others' rights.

    There is nothing about creating a derivative work in this license you've quoted (which is what you're doing when you create a new work from the PLR audios).

    They've explicitly restricted giving away the audios themselves as a deliverable - you're not doing that.

    The overwhelming majority of PLR licenses are a cut/paste afterthought, much to the detriment of the PLR sellers and buyers alike.

      Thanks. I wanted to offer the audios ( after creating animated videos from them ) as a bonus for signing up, but since this is not explicitly allowed, ( I hav only the right to sell ) I'll have to get another audio PLR for the job. Fortunately, I have already found an alternative with an excellent audio quality and a licence that states [YES] Can be used for opt-in bonuses (newsletter signups, etc.). I think this the way to go

        You are missing the point.

        You cannot create the animated videos.

        What McLeod was pointing out is that the videos are derivative works from the audios. Only the copyright owner has the right to make a derivative work. This means unless the license expressly allows you to do this (and it does not) then you cannot make the videos.

        His point about many licenses being cut and paste is that the audio creator may not have even thought about derivative works, so the issue was not included in the license. As others have suggested, if you contact the owner you are likely to get approved to do what you are wanting to do.

          I did not miss the point, the mention of the derivative work is what I intended to do before the whole matter was explained. It is crystal clear now that any derivative work is subject to the same restrictions as the original work, that's why I moved on and found a new PLR which states clearly that it can be added as a bonus for signing up new customers.

  • If you have any doubt on PLR licenses, the best thing is to ask directly to the author that will give you the best answer. Sometimes I ask if I have translation rights, for example.
    Or if there is some misunderstanding on rights, do it.

    You should consult and refer back to the product creator.

    The license stated that you can't offer the audios within IM niche, this may means, IM and MMO, MM field of services not allowed.

    I always am very concerned about "copyright" thing, so my first priority is to get ideas from plr products and then creat my own, or if I want to use it as original then I read the terms and conditions carefully or ask the person directly.
