Someone is promoting download links to my product

Some dude has created a YouTube video (with my video) and the description contains links to a file sharing site where people can download the file for free.

I'm filing a complaint with YouTube to take it down.

YouTube is asking me "Please cite the specific law that the content is allegedly violating, or the area of the law from which you believe your claim arises"

Should I put DMCA? I'm not sure what to put here. They also want a hyperlink to the specific law.

Thanks in advance.

Don't forget to serve that DMCA on the file sharing site, with naked CC: to their host and domain registrar...

And if you can, change the download link.

Well, the product is uploaded to their servers. I should of been more clear on that.

This is the site: ForoNsN - Compartiendo conocimiento colectivo.
      Looks like it's in spanish.

Thanks guys, I submitted the complaint to Google, now we wait.

You were totally clear on that.

Are you really only concerned with the YouTube video, but okay with the site the video is pirated to?

Or would you rather have the file removed from the pirate site and take steps to keep whoever stole it in the first place from simply downloading another copy.

If the video is you problem, you've complained to Google. You're done.

Otherwise, spend another ten minutes on the other steps and take back your product.

Change your download links and put another sales page in the current links location. Then send the file sharing site your complaint and that you are the product owner, etc. Tell them to disable the link.

The fastest thing to do is to go after the site on which the file is hosted. Most file sharing sites have an abuse or DCMA link down the bottom with instructions on who to contact to submit your DCMA. Submit your DCMA and tell them to confirm once the link has been removed. If you haven't heard anything within 24 hours then send another email to show them you are serious.

No point going after the video since they can easily just create another video and do the same again.

put a squeeze page on the page he's promoting. He'll probably remove the video himself soon enough. In the mean time, enjoy the free traffic.

David, did you read the actual post?

The file is being hosted on a file-sharing (aka, 'pirate') site, not his own, so he can't just "put up a squeeze page".

The video is promoting the download on the file-sharing site, not the OP's, so he isn't getting any "free traffic" - the file-sharing site is.

Send DMCA to the file sharing site but...once illegal sharing starts, it never stops.

Try to automate the process (sharefense or some subscription based service etc) or it will really time consuming.

I have to agree with that. I don't know what OP product is, but once it hits torrents and its out there, those that want it free will get it free.

Way to fight that is release "new version", "v2", "updated edition 2014", and advertise how much better it is than version before it. After a while, that one will probably get pirated as well and you make v3, and so on. Digital products have short shelf life for most part anyway.

It's called warez mate, get used to it. You'll never be able to stop the spread entirely.
