Selling natural perfectly legal supplements is now a crime according to GoDaddy.

Long story short: Client, Long term legit business, selling perfectly legal, over the counter available products. They do wholesale to sports stores, they have their own offline outlet store.

GoDaddy
- Domain Suspension Notice -
Domain name suspended for violating Section 5 of GoDaddy's Universal Terms of Service. Domain suspended because our investigation found it so be associated with the sale or distribution of prescription medication and or controlled substances
And they've spent the last week basically ignoring their pleads of innocence. Telling them to say bye bye to their site. The site was doing really well too.

Madness....

Have you called them on the phone, or are you trying to handle this over e-mail?

There must have been at least one product that violated the controlled substance rule. Maybe something that just went into effect recently?

Sounds like you still need to get the right person on the phone.

Yea, definitely call and talk to someone. Their phone support is good. If the rep doesn't have your answer, go over their head and ask for a manager. Keep pressing until you get the answers you need. If you're innocent, I wouldn't quit until it's resolved.

    Good luck!

Thats harsh. Time to get a lawyer involved if they are genuinely innocent. Some of those sports supplements contain banned ingredients depending on where they come from. I use a few myself because I love cycling. The cheaper products can get contaminated if they are produced in factories with other products etc. I use the following companies products which I grabbed this snippet from:

To ensure you receive the best possible product quality, we manufacture our products in our own modern factory, using the highest quality ingredients. Rigorous quality systems ensure that we comply to the very highest standards so that no banned substances enter our supply chain.

Are you sure they haven't unknowingly sold a banned substance on their site?

Not that I support GoDadddy (I have heard plenty of horror stories to keep me away), I have to agree with ronrule. Even companies that seem incompetent usually are reasonable when you get the right person on the phone.

If your site was doing really well, maybe consider legal representation to object to the illegitimate voiding of your contract with GoDaddy (the domain)... Of course, I'd do your research long and hard before even considering this.

As a final note, if it's just the domain, can you transfer the domain to another host? In the meantime, maybe buy another similar domain to keep the site up, as it sounds like your hosting account wasn't seized. And if it was, you should really have a recent backup of your site at the ready.

Good luck. GoDaddy is no friend of mine either, and I'd love to see you come out with a victory on this one!

As a final thought, have you considered the legality of what you're selling on a worldwide basis? Something you're selling online might be legal in say the European Union, but not legal in the United States. Then GoDaddy would be almost required to suspend your account as what you're doing isn't legal everywhere.

Google is a good example of this. You know how much censorship Google-China has?

Thanks for the guidance. I'm not handling this myself but will pass it on and get them to try and check everything again.

They could be right. Some supplements are pulled from the market and the store might be still selling their last stock. e.g. jack3d. Otherwise, if not guilty, in Australia, I'd call consumer affairs/ombudsman. But not sure what you have for equivalent in US.

I'd call your lawyer immediately... If these are not prescription (which they're not) then they cannot just shut it down because they feel like it. Get your lawyers involved and at the very least force Godaddy to release the domain name so you can move it to a different provider.

I am so sick and tired of the little guy getting stomped. If it where a large corporation they wouldn't dare do this for fear of being sued to death...

I do also work in and with pharma clients, so you could say I do know the difference. And yes what they sell does no contain any controlled substances. But anyone who had actually spent more then a second on the site would know that without question.

Anyway the decision has been made to route the site to another tld and go from there. Messing around with a legal approach could take months, and after that downtime, whats a domain really worth?. I'm fairly confident in returning things to normal quick enough. With a little shifting and shaking.

Arguably, Go Daddy can (and did) because of this:

      GoDaddy
      - Domain Suspension Notice -
Domain name suspended for violating Section 5 of GoDaddy's Universal Terms of Service. Domain suspended because our investigation found it so be associated with the sale or distribution of prescription medication and or controlled substances
In turn (and just a shortcut version of it):

      Legal Agreement

      5. GENERAL RULES OF CONDUCT

      You acknowledge and agree that:

You will not use this Site or the Services found at this Site in a manner (as determined by Go Daddy in its sole and absolute discretion) that:

      Violates the Ryan Haight Online Pharmacy Consumer Protection Act of 2008 or similar legislation, or promotes, encourages or engages in the sale or distribution of prescription medication without a valid prescription;
Unfortunately, one will have to sue in a court of competent jurisdiction if s/he
wants to (possibly) show that that thing isn't legal. Go Daddy, however, is no
      stranger to lawsuits.

I wish someone at Go Daddy honestly told you why, OP, although I understand
their hesitation if their answer is (likely) unacceptable:

Rogues and Registrars: Top 10 List (October 2012)

For years, Go Daddy and other registrars have been pressured by other parties
(i.e. law enforcement, LegitScript) to do something about websites selling drugs
without prescriptions or similar. Thus, your next registrar may have that issue as
      well if you switch.

It's absolutely fine by me, that they go after such domains. But this was more a case of mistaken identity. And hard to explain when protecting people. But you can take my word for it. If you landed on this site you would know for sure, your not at a pharmacy.
        But anyway, thanks.

Like Mike said, getting your lawyer involved is certainly the right thing to do here. But then again, also be ready for an uphill battle when you take legal action - just one of the disadvantages of being the "little guy". Nevertheless, I really hope things work out in your favor!

This is precisely why I always warn folks about how horrible Godaddy is as a registrar. The have anti-consumer policies and are unethical. The #1 worst thing they do is confiscate domains for "spam" (or other) reasons, when in fact many are NOT be used as such. They have a policy of "shoot first, ask questions never".

Use a better registrar. Move everything away from them. Use either Namecheap or DirectNIC,

I've never heard of a registrar other than go daddy confiscate a domain unless required by udrp or court order.

Go daddy seem to have taken it in themselves to enforce anti spam, consumer protection, address correctness, copyrights, trademarks, and all sorts of other stuff. I'm not against enforcing these areas of law, but i just do not agree that it is a domain registrars job to be a self appointed judge, jury and executioner.

sadly that's business on the Net. here today..shut down tomorrow.

Once they gt heat from big authorities above, they won't give 2 cents about the hundreds of small businesses.

They could have at least given you 48 hours to transfer/challenge it. but this is the Net.

Been there...done that. They'll eventually ask you for around $500-$750 to re-enable the domain...if they agree to re-enable it. Good luck. Never use them again.

Any registrar on the LegitScript program could have done this. Posters here recommend NameCheap over GoDaddy a lot, but even they work with LegitScript.

They don't take down sites that sell all natural supplements. One possibility is an "all natural" supplement was found to contain a controlled substance. Then they (LegitScript or whoever) went in search of sites selling that supplement. Some sites turn a blind eye to the news so they can sell remaining inventory and others just don't pay attention to anything until it comes time to reorder and they discover it isn't sold anymore.

Before condemning Godaddy if this person is physically selling the product he/she opens themselves up for possible legal problems, especially if the products claim to cure, prevent, mitigate, or treat a disease. GoDaddy just doesn't want to open themselves up to any legal problems.

Sorry to hear about this bad experience, I prefer to stick with Namecheap nowadays.

A lot of hosts and registrars won't risk any borderline stuff or anything that could potentially get them in trouble with the law, so will ruthlessly close down any sites that could land them in trouble.

Members of this forum have been advising for
10 years or more to never, NEVER, get your
domain and hosting from the same vendor.

When they can control both, it's just too much power.
