Question About the Use of Images

I had a question about searching for photos using the Creative Commons' website search function (CC Search).

For example, if I found an image on Flickr that has a specific license that says anyone is free to "copy, distribute and transmit the work" and free to "adapt the work" and are free to "make commercial use of the work" as long as you give some sort of credit to the content owner, legally speaking one could compile a bundle of photos that fall under this license and resell them, provided there is some sort of credit back to the content owner, correct?

Thanks for any help

Please do not quote me on this one. I do not think so. Currently, I have photos on Flickr that are listed as creative common. Well, people can use em. However, you cannot sell em. That is what I have been told, but I could be wrong.

    You can use them...

But I doubt they'll be cool with you turning a profit off of them.

Unless of course they're on a site that is making money via ad revenue etc.

Can you not contact them directly and ask for permission?

Also, be sure to source them regardless just to be on the safe side.

That was something I should have mentioned. On Flickr in particular, people who upload photos can choose the type of rights they want to allow on their images. If a bundle of images was compiled where all images had the commercial use rights, and credit was given back to the original content owner, my understanding of the licensing rights would allow for resell of the images. But again, I could be wrong

Whoever puts these images on their site, regardless of what you tell them, or what you believe to be true, are liable.

I'd really follow through on finding out from a legal person to keep yourself and a lot of others out of trouble.
