Hi,

I've outsourced the creation of ebooks in the past using elance.

Is it exactly the same if I want to create a script / software?

Can I just go to a site like elance, get a programmer to create my script, then sell it on as my own for a profit?

Does there have to be any contracts in place or anything?

It's pretty much the same concept, yes. And Elance has a resource section with sample contracts you can use:
