Is it illegal, and can you get sued and go to jail for doing arbitrage work?

By being a middle man and saying that other peoples work is yours, isn't that copyright?

    It is legal if you have a deal with the person who created it. But if you're going to claim that it is your work without the real creator's consent then I think it is illegal and he can sue you for stealing his work.

    In some situations that could be a problem.

    A lot of newbies seem to think they have to be sneaky about it. You are actually better off telling the designer/programmer/writer/whoever that the work is for your client anyway.

    If your service provider has a problem with this then you need to find someone else to work with.

      Couldn't agree more. You are paying a designer for a project. The designer create the design, then is paid. What YOU do with that project is your own business, but I would make sure you clarify that with the designer so there's no issue. 99 out of 100 times they won't have an issue.

    Yeah, you are overthinking this. It is not a legal issue, it is a business model issue.

    Be honest in your dealings, and you will avoid a lot of the problems you are worrying about. You don't want to be the creator anyway, so don't sell yourself that way.

    Develop multiple suppliers that you can work with, and ramp up your business as a broker of quality services.

    Look at realtors. They don't own the property that they sell to the buyer and the buyer knows it yet accepts doing business through the realtor. When you remodel or paint your home, you hire a contractor and he hires other independent contractors to do specialized work on your home. How is it any different for you? You are the "middle person" and you "organize" or "manage" the project for your client. If you find someone who can do good quality work for your client - and your client doesn't know the field as well as you do, in that sense you are adding value and should be paid the difference for your "work". When I buy something from Walmart or Amazon.com, I don't say to myself, "Where did Walmart get this item from? Maybe I can buy it directly from their supplier and get it cheaper." The idea never crosses my mind. It just isn't worth the hassle of finding out.

  • Maybe, if you totally reveal here what you are planning to do then others can give their opinions but it won't be legal advice though as they are not lawyers. Don't pretend something is your's when it ain't as that is copyright infringing, in my opinion and would fall in trouble (again in my opinion).
