Domain & eBook Trademark concern

INTERNET MARKETING

Hi there,

I have a quick query regarding a domain and an ebook website that I am intending on purchasing that has been selling an ebook on clickbank since 2011.

The domain name and the ebook contain the words

"for dummies"

I did some research on the net and can see that this is trademarked to the books from 'For Dummies". This person is trying to sell this established ebook clickbank site for $6k.

Would you advise stay far away from it due to these keywords used that possibly infringe on the trademarked words 'for dummies'?

Any advise would be much appreciated.

Yeh, I'm surprised that the ebook got this far with no infringement notices unless the seller has received one and is trying to sell it to pass on the problem to the new buyer.

As far as ClickBank I would of thought they would filter out trademarked products but probably this is the sellers responsibility and they don't hold themselves accountable?

You could rework it to take out the possible infringement, new domain, new product title, etc.

Obviously I don't know the particular circumstances - but people who are careless about 1 of these things, are often careless about others. So I would double-check other aspects of the product, for trademark & copyright infringement, or other issues, such as product claims, etc.

FWIW, I don't think it's ClickBank's job (nor would it be practical) to investigate every single product in detail for every possible trademark, copyright, patent, or trade dress issue. I suspect in their vetting, they would just look for really obvious ones, and leave the rest up to the vendor.

don't even think of. It's violation of copyright. Remember dummies is wiley's brand and its nasdac listed company. Stay away bro

Thanks to everyone that posted and I will stay right away from it unless the owner wishes to sell the ebook for a few pennies since the domain and the ebook title infringes the copyright and playing against such a big company will only get you into serious trouble. I contacted the support at Wiley's and they also said that with permission you can possibly obtain a license through Wiley but has to be reviewed by them but that could be in the thousands if not more and would mean royalties to them so there is absolutely no point touching it.

  So not worth getting involved with in any way. There are so many easier ways to brand something than getting involved with something which is already protected so fiercely.

  Don't just pass on the offer . . . run away as fast as you can.
  
  If the site/product was making a lot of money, it wouldn't be for sale.
  
  Since it is for sale, it either isn't very profitable or, as others have suggested, it may be under scrutiny for trademark infringement.
  
  The only way you don't inherit problems is to not get involved.
