The site's owner might object. Why not go googling for open source templates? That way, there are no future complications to worry about.

  • Your own written content is yours & copywrited to you. Maybe find some generic pics that will suit your website.

Lot of people use other websites, artwork, copy, etc. for inspiration but copying outright can be considered a derivative work under U.S. copyright law.

A "derivative work" is a work based upon one or more preexisting works, such as a translation, musical arrangement, dramatization, fictionalization, motion picture version, sound recording, art reproduction, abridgment, condensation, or any other form in which a work may be recast, transformed, or adapted. A work consisting of editorial revisions, annotations, elaborations, or other modifications, which, as a whole, represent an original work of authorship, is a "derivative work". A "similar design" isn't a problem if you mean taking inspiration from other sites regarding layout. If you mean directly copying, then yes, it is a big problem.

That includes copying pictures - the copyright to those pictures will be owned by someone. If you want some free pictures, go to stock.xchng - the leading free stock photography site

Monitorit, please don't take this the wrong way because it's mean to help.

Based on your posts in this thread, you really need to hire someone to write your content for you or get an editor to clean it up.

Why would you want to use someone else's web design? Is there site bringing in huge amounts of sales? If it is I would assume because they know how to drive traffic to their site.

To avoid embarrassment or harrassment, make you own site and drive your own traffic there.

If the images are ones freely available to use there isn't a problem. I would not copy the design but instead look for where you think their site can be improved and get a designer to create you a "better" one. The layout can be similar but get your own design (graphics).

I wouldn't call it cheating, unless you were trying to copy the style and then call it your own. theres nothing wrong with borrowing ideas from others (no artist is an island onto himself) just make sure you add your own style that's uniquely you!
