Sure, it depends upon what videos you use in the thumbnail.

It depends on what the end use of the thumbnail is. In the cited case it was ruled the search engine could do it but that does not mean anyone and everyone can do it for every purpose.

Having considered the four fair use factors and found that two weigh in favor of Arriba, one is neutral, and one weighs slightly in favor of Kelly, we conclude that Arriba's use of Kelly's images as thumbnails in its search engine is a fair use.
The four fair use factors that are to be considered are:

--> Purpose and character of the use
--> Nature of the copyrighted work
--> Amount and substantiality of portion used
--> Effect of the use upon the potential market for or value of the copyrighted work

      Regards,

Thanks for the replies. There never seems to be a black and white answer these days.

There's actually another plugin out that will turn the embedded youtube video in the post, into a smaller embedded player where the featured image goes.

All of this really shouldn't be an issue with youtube videos. They are already giving you the embed code for your site. Taking a thumbnail of that video as your featured image shouldn't be a big deal.

You're right on both counts. Unfortunately there are very few simple standards or guidelines on any copyright issue, it seems to me.

That's so true when it comes to digital copyrights. Each case is unique and laws can be interpreted differently by different people. Laws differ from country to country, laws and people who write and apply them change all the time. In the above example, that specific court gave a conclusion in favor of fair use but another court might have given a different conclusion.

My philosophy in copyright issues is that do if you are 100% certain about it. If you have doubt, ask for confirmation from the copyright owner, if there is still doubt, stay away from it. It's just not worth the headache unless you have the time, money and resources to defend yourself in legal platforms.
