Graphics and copyrighted images

I plan to do digital kid invitations and I'm wondering the best way to accumulate graphics. I see what they do on Etsy and they have a disclaimer that says that they are giving away those graphics (like Disney) and only making money on their time to put it together. For me to be successful, I have to be able to design invitations that use Disney characters and images like that. What can I do and is stock photography the only way? If I put a disclaimer, can I just use Google images - ok that sounds wrong just typing it lol so I'm sure I can't do that. I just need to access a lot of graphics. Thanks for your help!

    Hello,

Most of the Disney stuff is copyrighted and/or trademarked so you would need permission to use the characters legally. You could try to approach them for a license... Companies like Dairy Queen use Disney characters on cakes and they are paying royalties on each character and/or scene they put on a cake.

Stock photography would be the next the best way to go as it allows you to get properly licensed and released images.

Google Images does not own any images so you need to check with the source to make sure you can get permission and/or a proper license to use the images. Google has some filters you can use but those are not foolproof and the accuracy leaves a lot to be desired.

You could source public domain images from some of the free sites but then you are crossing your fingers that those images were actually placed into the public domain by the image source.

If you are wanting to do Disney characters the best way to go about things is to try to obtain the rights to use the characters through Disney.

    Cheers

That is a hard one because if you are going to use Disney characters, I would be careful and find out if they allow this.

You don't want to create these graphics and then have them find out that you used their characters. That could create a big problem for you.

    You might have copyright issues.

Maybe you should come up with your own characters.

I am heading to the licensing expo in Vegas next month. If you want to license cartoons that's the place to do it.

Most brands like Disney and Nickleoden will charge you a % of your sales for using their art.

If you try to use the cartoons without permission you will end up in a legal mess.

I think it would be cheaper to hire a graphic artist to come up with your own graphics. Will probally cost a fortune to use Disney. If Disney is not an option then use stock images.

Never assume that just because "others" are doing things a certain way you are given permission and a "right" to do that also. These people don't know better and believe that if they give attribution and don't sell the images outright they are somehow free from copyright or trademark law. Nothing could be further from the truth.
