            I think what people have to look at here is the comment about misleading advertising.

            A lot of people in this market think that it's okay to hint at things as long as you don't say them outright. That is not how the law reads in the US, and playing those kinds of games will cost you.

            I suspect the appeal will result in a large change in the penalties imposed. Those are way beyond what similar cases I've seen have resulted in.

              Yeah I agree! They will catch up with people sooner or later.

              It's the total ignorance that gets me. People don't seem to be seeing the warning signs.

              I saw a case a couple of months ago where someone was selling football jerseys they bought from some wearhouse, then tried to sell them in their local small town retail store claiming they were from XXX company. The inside label read from "Thyland".

              The judge found them guilty of fraud for ever place they advertised.

              The funny part about it is that the guy selling the Jerseys claimed he didn't come right out and print it in any advertisments, not even on his signs at his store. The Judge however stated otherwise ... claiming, using the XXX companies name in conjunction with his Jerseys on the same advertisment, in the way the store owner worded it, was every bit as misleading as standing on the street corner trying to sell the Jerseys and coming right out and saying XXX company made them.

              He was fined a hefty fee, plus jail time.


              I see no difference between what this store owner did, and what some people try to get away on their sites/blogs. Misleading people is fraud to me.

                This is why I despise pharaceutical companies. If it was up to me... not just these guys would pay. I would also make certain they removed all drug related advertising from the tv stations... or any format of tv... including websites that play videos like tv shows or movies and stick those ads in between sections of the video.

                You have some half naked chick running around on a beach or in a bedroom selling a drug about the latest fad illness... which has nothing to do with being in a bedroom or on a beach. They glamorize these drugs... so people go asking their dr about these drugs... or try to obtain them illegally online.

                Doctors are the only people that should even bring these drugs up.



                Does your head hurt at least once per month?

                Have you ever been out of breath this month?

                Have you felt frustrated this month?

                Then you must have [enter the latest fad name here].

                See your doctor about [fad name] and tell him you need [new drug name here].

                There is nothing wrong with you... chasing after brats all day after a long day of work will give you these symptoms.

                Granted that is a little exaggerated... but these commercials piss me off. Especially since during prime time... 3 out of every 4 commercials is a drug commercial promoting the latest fad illness for the latest fad drug to go with it.

                    Those had to be the absolute cheesiest commercials ever
                    aired yet they produced enough sales so that the guy had
                    nearly half a billion dollars to be forfeited...

                    There is no shortage of people who will pay good money if
                    they even suspect your product will solve their problem.

                        1. They had that many small penis customers.
                        2. The customers were dumb enough to order this sh*t.

                        Now, what is it that we notice when we see an ad for an "FDA approved" drug? The damn side effects!

                        An usual ad goes like this:

                        "Allergy B Gone - Take this little FDA approved allergy pill and you will eliminate all of your allergies in a minute flat!

                        Side effects include
                        • Diarreah
                          Heart Burn
                          Extreme twitching
                          Mild love for internet marketing
                          Toe itching
                          Evolution
                          Upper respiratory tract infection
                          Gas with oily discharge
                          Mild case of DEATH!


                          These drug manufacturing companies are making billions of dollars off of morons that buy into these pills. What's wrong with people? For $165 dollars, I may lose weight, with the additional cost of having diarrhea, cramping, rash and my personal favorite: gas with oily discharge. BARF.

                          You want to lose weight? Exercise. Quit buying into these stupid drugs and pills. Lazy *******s.

                          Damn... someone over at the marketing department must have been asleep at the wheel, because there are few things I can think of that I'd rather not have than gas with oily discharge.

                          Maybe the doctors/chemical engineers or whoever concocts these pills got tired of working on it and investors forced them to publish the drug before it was perfected (long before it was perfected).

                          I can just picture the doctors saying "...but this drug will give people the shits!" Only to be responded with "Our investors are getting impatient. Besides, that's why toilet paper and depends were invented..."

                          Don't buy drugs to solve your problems. Allergies aren't that bad. Suck it up and grow a pair. A nation of wimps, I tell you...

                          Good post up until that part. You've obviousy never had severe allergies. I took weekly shots for about 3 years when I was younger. And now my allergies rarely if ever bother me. To the point that I never medicate (even OTC) for them. And I'm exposed to the exact same environmental conditions.

                                  I'm gonna try very hard not to climb up and jump up and down on my soapbox, but as a nurse, there's very little that gets my ire up more than Big Pharma...I loathe the multi-gazillion dollar pharmaceutical industry with every fiber of my being. They're destroying lives with their symptom masking drugs, most of which cause more problems than they solve.

                                  There's a special place in hell reserved for these pill-pushers and I wonder if the average person has any idea how much power and influence these companies have.

                                  Now, before you laugh, watch the video...it's not hard for me believe what he says is true, since I've suspected for a long time there was a cure for cancer. But there's too many billions of dollars wrapped up in it for the truth to be let out.

                                    So true nursehoney, so true. People dont realize the Billions and Billions of Profit the Big Pharma will lose if a cure for Cancer is produced. Actually we probably could have had a cure years ago and I wouldnt put it past them if they do have one that is locked up in a vault. There is too much Profit in the treatment of Cancer.( chemo, pills etc...) for these Big Boys to try to find a cure.

                                            So with that out of the way, I said I think the prison sentence is disproportionate to the crime.

                                            If he really did rip off millions of people, then why only 93 counts of mail fraud? Mail fraud is one of the most ambiguous laws written...I suggest you read Gary Halbert's story, he also went to prison for mail fraud.

                                            The feds went on a fishing expedition to get this guy because of the volume of money he had aquired.

                                            False advertising or false nutritional claims are typically handled by the FTC and FDA. They involved a federal prosecutor because they smelled blood in the water. (i.e. lots of money to grab)

                                            The reality is that just about anyone in the USA could be found guilty on any number of charges if a prosecutor wanted to make it happen...there's a reason the US has the highest rate of incarceration in the world.

                                            It just kind of makes me ill to see so many people celebrating such a huge sentence for a nonviolent offender especially when the profits have been confiscated.

                                            The average sentence for murder in the US is about 15 years.

                                            Financially, look at the below quote:

                                            • There are a lot of people who make or have made a whole bunch of money. Warren Buffet, Bill Gates, Steve Jobs, the late Sam Walton. The feds don't just "go after" everyone who makes a lot of money. I'm sure the feds aren't perfect, and I'm sure some of you will say they are corrupt. However, to say they simply went after this guy because he had acquired a lot of money is very short sighted. He was defrauding millions of people and taking their money. That is against the law in the United States, as well as many other countries.

                                              If he really did rip off millions of people, then why only 93 counts of mail fraud? Mail fraud is one of the most ambiguous laws written...I suggest you read Gary Halbert's story, he also went to prison for mail fraud.

                                              The feds went on a fishing expedition to get this guy because of the volume of money he had aquired.

                                              False advertising or false nutritional claims are typically handled by the FTC and FDA. They involved a federal prosecutor because they smelled blood in the water. (i.e. lots of money to grab)

                                              The reality is that just about anyone in the USA could be found guilty on any number of charges if a prosecutor wanted to make it happen...there's a reason the US has the highest rate of incarceration in the world.

                                              It just kind of makes me ill to see so many people celebrating such a huge sentence for a nonviolent offender especially when the profits have been confiscated.

                                              The average sentence for murder in the US is about 15 years.

                      I remember in the middle of Edna's investigation, the Secret Service Agent I was working with told me that it may seem like these federal cases take a bit longer that other types of cases, but the people often end up doing more time than they would for other types of cases. In Edna's case, had it gone to trial, she would have been looking at 30 years for bank, mail, and wire fraud.

              While I think this guy was obviously scamming people out of money, I don't really think he deserves a worse sentence than murderers, rapists and child molesters. That's what is wrong with this country. People tend to simply IGNORE all FACTS of REALITY and are all too happy to judge someone based on a simple "factual" artice.

              These same people only start to think differently when something similar happens to THEM.

              I agree with some of the comments around here talking about how the Gov't loves to monitor BIG MONEY and attack those behind that money, so that they can get their hands on it. This is WHY some perfectly legit MLMs always FAIL. Big Brother is ALWAYS there trying to get as much of your money as possible.

              Since they are confiscating Mr. Enzytes MILLIONS anyway, why not send the money back to where it came from? I.E. The people that were SCAMMED out of it in the first place.               It's sad how powerful Big Pharma is. Has anyone else noticed that more and more children are getting on prescription drugs for add/adhd w/o any real benefits? I know I have. The schools seem to push pretty hard to drug your children these days. There is a magic pill for EVERYTHING and ANYTHING now. Of course, none of them really work. They might mask some problems, but in the long run they almost always cause more harm than good. Especially in children.

              A few years ago, I was working at a doctors' office and on my break I seen a medical journal and started reading it. I found an interesting article about a cure for HIV/AIDS. It was pretty exciting, but saddening too. The cure is too inexpensive for Big Pharma. It's a simple injection of hydrogen peroxide available just about anywhere. Now, the article did say that the injection(s) would need to be administered as early as possible for effective use, but the point is this is stuff that they don't teach in medical school. The information is intentionally hidden from those who need it.

              Isn't that a bit distubing?

    Lol, anyone with half a brain knew those pills didn't work as advertised. If they didn't think the commercial was fake, they have a lot to learn.

    I think people sometimes by products like that knowing they don't do anything, just so they can sue the pants off of someone.

    Anywa, I think in this case they got what they deserved.

    • Yeah, that's what I was thinking, too. It was a really bizarre refund policy, but that's not what got him into trouble. What got him into trouble was that he was breaking the law, including money laundering.

          It really disturbs me that so many people are happy this guy got a sentence greater than most murderers and rapists...not to mention Fortune 500 CEOs who committed even worse financial crimes that in many cases actually ended up hurting thousands of people by destroying their retirement money.

          I'm not saying he isn't guilty of false advertising...but 25 years?

          What about pharmaceuticals that actually kill people...?

          Seems to me, this guy's biggest crime was making a lot of money.

            Based on Warshak's conviction last February on 93 counts of mail fraud, bank fraud, conspiracy and money laundering, U.S. District Judge S. Arthur Spiegel sentenced him to 25 years in prison, fined him $93 million, and forfeited $459 million - that's nearly half a billion dollars - of his and his company's assets to the government.

              Doubtful IMHO.

              The guy was hit on 93 different counts.

              Money Laundering alone carries a 20 year sentence. He got off light.

                Perhaps Floyd, but re-read what constitutes money laundering and you'll see how that charge will likely be one that gets dropped.

    This is my first time to hear of this news. The conviction will serve as a warning to all firms marketing penis enlargement pills. If those potions don't actually work at all, why i can see still a lot of adverting for those type of products.
