If you're seriously worried about protecting yourself

With the moves being made by some states which threaten to gum up how affiliate sales are handled, you may be interested in incorporating in another state. If you're a sole prop and you want added protection, you may also be interested in incorporation or forming an LLC. Well, Nevada has some of the most liberal regulations for incorporate among all of the US states.

I recently received notification of an offer which makes incorporation in Nevada pretty darned affordable. I'll share the link with you here:

The company is offering to form a Nevada Corporation or Nevada LLC for just $99, including the state filing fees. They are also throwing in one year of free registered agent service, one year of free unlimited first-class domestic mail forwarding, and one year of use of a Nevada business address. After your first year of service, they'll do the registered agent service, the unlimited mail forwarding and the business address for just $99 per year.

I'm not connected to or know anything about this company, but the price struck me as worth posting here.

    Even if you incorporate in another state, most states will require you to again register in your home state as a "foreign corporation" which would defeat the purpose.

    Registering out of state can also open up a variety of tax issues...how can you write off those office supplies or computer if your company is in a totally different state?

    There are ways you could do this, but they are a little more complicated than just registering out of state and proper legal help would be advised.

    Interesting. I wonder if this is going to end up like the European VAT law. Screws home companies while giving foreign companies the ability to not charge tax.

    As it is now, I can sell to anywhere in the US without charging sales tax and Americans can sell to the EU without charging it even though they're legally obligated to do so. Nobody does anyway.

      I know. I was referring to merchants who use their own platforms. Nobody of the people I know who do their own thing are collecting any taxes at all.

    You really should get competent tax and legal advice before you incorporate in "corporation-friendly" States like Nevada and Delaware.
