What is Considered to be Text SPAM?

What exactly is considered to be SPAM?
If a user has an app and can send out a text message through one of its features(using the user's cell#) to a friend's cell phone, would it be considered SPAM? Remember that the message itself is from the user and not generated as a commercial offer or solicitation from the App company.

For example, would this be SPAM?:

From: 917-445-4545(Josh Smith's Cell#)
Message(to friend):
<Josh Smith says: "Let's Play Football"
To view details, download the Widget App from the AppStore.>

(Downloading App allows user to view full details of message, such as time or location, etc.)

Would it be any different if instead of the message coming from "Josh Smith's" cellphone, it came from a number or server owned by the Widget App company?
:confused:

I like this ponder.

If the message with no apparent value leads to a goldmine of usefulness,

and the message with an ironclad promise of riches leaves you looking forward to a coldbath,

Which is spam,

JP
