I know we have to have laws, but this one seems a little harsh:

    10 years old - even in America that is too young to be cited for a misdemeanor? On the other hand, NY is broke and every $50 helps.

    Sounds like the commissioner was duly embarrassed by the action of his team. That's at least a good thing. People in power in the US are just going freaking nuts over it any more. Too bad there's more Barney Fifes here than Sheriff Taylors.

    Sounds heartless, but she broke a LOT of laws! Health codes, tax, business, etc... $50 is CHEAP! Just a business permit often costs $100+!

      Yeah - I'm thinking that if Daddy hadn't been there they might have just asked her to shut it down and told her why - kids don't know better, but there's daddy in the booth and adults are expected to play by legal rules. The citation, though, should have been given to him, not her. There was no way for the officials to distinguish whether it was actually a kid's stand or if it was an adult using a kid as a cover.

    A lemonade stand isn't really a unique idea. The APPLE II even had a game called LEMONADE, and guess what IT was!

    The law SHOULD be applied equally. I she wanted to run a lemonade stand, it should have been on THEIR property with at least insurance. It would STILL be illegal, but it would be a bit better then. It is bad enough with the legal vendors.

    Not initiative for innovation, but for making her own money is what I meant.
    I never saw the game lemonade, bot I remember root beer tapper!
    While I do agree the law should be applied equally, I should have clarified that it is my opinion that ,as I think a lot of us agree, we have a lot of stupid laws.
    We need to get back to a country of common sense and not regulation, though I think that's an impossible dream.

      We DO have stupid laws! Sales taxes and permits are really illegal and should be abolished. But there ARE valid healthcode laws that aren't enforced and children are MORE likely to break them. ALSO, there are labeling laws. And there is fair trade. The kid broke ALL of those.

      The Apple II game of lemonade was interesting, You had to plan out how much you should spend, etc... and things changed to make it a good or bad day.
