    Well that's a relief that I won't be charged for illegally singing Happy Birthday to friends and family for all these years.

      As much as I think the Lawsuit is silly it is the proper Protocol.

      Songs are written and each song has a Composer and Creator. It's like anything if you get it copyrighted/ Trademarked etc..etc.. then there are channels you have to go thru to make something like this Public Domain.

      Warner/Chapell had every right to collect. Absolutely NO question.

      I'm just glad it is Public Domain now

        Agreed, same. As a marketer I don't really want my copyrights and trademark rights being diluted by the courts. Granted, the owners of the copywrite were being a bit aggressive. Which of course, it was was bogus anyways.

    I always said that was bogus. HECK, EVEN a copyright by the originators could be called into question, but that was LONG ago.

    And leaving it to the public, with no repercussions, claim of copyright, or even complaint, DOES make it public domain! HELL, one company bought one PROPRIETARY product, modified a PUBLIC DOMAIN(actually copyleft, but we will get to that in a second), and then claimed that copying their meager code was ILLEGAL, due to copyright!

    So WHAT is copyleft? Well, there is always the fear that some IDIOT will take a public domain work tweak it, and copyright it. So someone copyrights the work and throws it into the public domain so such a tweak under such circumstances causes an infringement they can prosecute.

    And with the "happy birthday" tune, never mind all the transfers and taking advantage of all the changes in the law, the basic music was apparently NOT written by the "authors", and the words are simplistic at best, and often changed.

    I noticed that riff the FIRST second I heard it *****LONG***** ago. I sang it DECADES earlier in a music class. It was one of the songs in a book used in schools in the US. It is about an AUSTRALIAN bird, and is apparently from there.

    You know, a book store once, called Amazon books, once sued a little company called Amazon.com for violating their trademark. Oh SURE, the suit was kind of baseless, I mean "AMAZON"? COME ON! There is a RESTAURANT in burlington called amazon! STILL, it WAS under a similar law. amazon books was told their case was brought too late.

    Oh well.

      What are they going to do, charge the whole planet with using this illegally?

      Same as imprisoning Aussies for illegal downloads, they would have to put up "Escape From New York" type fencing around a state, and throw the 30% or about 7 million of Australians in there!

      I'm going to try to take the day off.

      There is work available for me to do today (if I want to do it) and I will have to take another day later this week where I know it'll be impossible for me to do any work so I'm debating spending maybe just a couple of hours getting some work in. It's all deadline related. I have projects lined up through the end of April.

      Then after April there is work but the $ is uncertain. It is family related and something I offered myself up for to help out so I kinda gotta treat about 3 months of my summer as donated time. The experience of what I'm doing could be turned into money at a later date if I document what I'm doing properly.

      For the moment I'm finishing my morning coffee and then off to the store to get some crabcakes. Gonna make me some crab cake benedict! Yummmmmmmm.

        Congrats on the work! I myself have enough loyal clients online and off that bring me steady work that I'm actually seriously considering retiring my sites completely.

            I found some maryland crabcakes at the store this morning. Perfectly poached the eggs, cheated a bit with the concord hollandaise sauce. Found a couple of hash brown patties to go with it all.

            I could have gone out, but I am such a damn good cook, lol, it would have been disappointing.

            Months back when talking to my ex about leaving him he said, "aren't you going to miss cooking for me?" ROFL - and he was so serious...

            So brunch was just perfect. Not to mention I can really enjoy the poinsettas (champagne on ice with a splash of cran) and not worry about driving home as I'm already here.

            It's a sunny warm day. Complete opposite from where I was last year.

            Just really feeling relaxed and at peace.

              I can identify - cooking is my only real domestic talent. I often think about going out and end up cooking for myself instead...tastes better.

              We are blizzarding here at the moment. Supposedly we were to have an hour or two of light flurries. We're now on our 4th hours of heavy snow. I was out earlier but home before snow started (planned it that way).

              My son was out and about but made it home OK in his Jeep. However, he just left again as my daughter-in-law is off the road just 2-3 miles from the house. She's driving a 4 wheel drive SUV but these country roads can be tricky.

              Jeep has a winch so hopefully everyone will be home safe and sound before too long.

              Just really feeling relaxed and at peace.
