Trademark registration my domain name

If someone trademarks my domain name can I also trademark it?

    I'm not a lawyer, but....

    Absolutely not. In fact if they've trademarked the name they can (and probably will) be entitled to take legal action against and force you to give (not sell) the domain to them.

    There is a difference between trade marks and trade names that you should be aware of.

    Typically, trademarks are used to register and protect symbols, slogans, logos, and brands.

    Trade names protect the name of your business.

    If someone has filed a trade name and you haven't, regardless of who was first, you probably are at risk. If they have filed a trade mark, it most likely depends upon what it is they've trade marked.

    Of course, I am not a lawyer and these are just my opinions. Do yourself a favor and get competent legal counsel.

    It depends entirely on what goods and services their trademark is registered on. I assume you're referring to a US trademark and a federal trademark rather than a state trademark, in which case you should look up their mark on the USPTO register and see exactly what it's registered on.
