Dell problem

So end of January I ended up picking a brand new laptop from Dell a Studio XPS 13 which they stopped making now.. I don't know why.. So the heating vent of the laptop is seriously in a pretty bad place and it was on my lap and I was wearing track pants and something happened to the laptop now I just don't know what happened exactly and excessive heat came out burning me and also notice of excessive heat marks can be noticed on the laptop from the heating ventilation. But I really did not care however the next day my thigh had some weird tingling sensation and the doctor said it was a minor burn...

I called Dell about it just to tell them what happened... and wanted a replacement unit. They called me a Liar .. then they stated they will send me a replacement of a Dell Laptop after arguing that I am not lying... Should I get a lawyer involved?

I called Dell after 2 weeks asking what happened to my replacement unit they said it was not sent out, and for some odd reason nothing was done. A manager spoke to me about this issue right away and he said no no this was not suppose to happen. He then bundled me a laptop which was way better then my laptop but was still a 1340 XPS and placed on ordered and he said he going to report this as well to higher authority as this was not suppose to happen.

A week after I get a call from Texas... An Engineer from Dell and then he started talking to me and he does not want me to take this to the media or lawyers and wants me to sign an agreement which I just did not want to sign then he took the case to Gallagher Bassett i which I spoke to some extremely rude B*TCH.. and after all this problems and headache they making me go through I said okay I will sign agreement now they don't make the XPS and cant replace and want to give me a different laptop which I don't want.. They said they will give me money with depreciation on the laptop ...

What Should I do? I am not looking to make any money I just want a replacement unit of the laptop I ordered...

  • Well, since the laptop was NOT a laptop(able to sit on top of your lap), and you never really got to use it, they have no right to depreciate it.

    Maybe you should file a credit card dispute and/or file a small claims case.

  • When dell replaces a unit you will get 'like or better' If they can send you the exact same unit, they will. If they can't they will send the next step up.

    This is in your warrant/sla agreement that you probably didnt read because nobody reads them.

    Your single lawyer will mean nothing to dell and their battallion of lawyers.

    • I believe most states do NOT allow lawyers in small claims court. Besides, it is silly to spend THOUSANDS of dollars to fight for such a small case.

    • Actually I find this phrase redundant---but then I would rather toss parts into a case and make it work rather than buying off the shelf.

    Some might think the words Dell problem is an oxymoron, bu I consider it more of a pair of synonyms.
  • Nothing wrong with Dells. Problems usually come from inexperienced users. People who click every popup they see, dont do any maintenance, dont do any antivirus scans.

    Or the best ones are people who keep their computers for 10 years..which is a feat unto itself. But when that ancient dinosaur finally dies, its all the manufacturers fault!


    computeres have a lifespan. they arent indestructable and they are just a dumb box doing only what their users tell them to. If the user doesnt know what they are doing, there's usually only one way that the story ends.

    • 3 years old, the screen dies! WHAT PM should I have done to keep that from happening. BTW all other computers are working FINE, including one that I bought BEFORE it, and my latest has run 2 years with NO problems.

    Maybe I should have said Dell support.
    Probably the worst in the business if your the everyday home user.
    If your a home user you get the staff out of India or Pakistan.
    If your a business user you get the staff out of Texas.
