Women falls asleep on airplane and sues...

I just lost my $100k/yr job due to a job merger, and I did nothing wrong,
but yet, I am unable to sue for any damges...

This lady falls alseep on an airplane, and sues the airliner
because no-body woke her up (oh they left me here, oh
I am so damaged, I am so hurt, so i am suing)

This lady lost nothing, and she gets to sue.

I lost my career, and i get nothing.

    And I don't think it's right of her to sue them.. it's her own fault.

      Thats not really the point...

      She gets to sue because she fell asleep on the plane, and no one woke her up (she was not harmed in anyway)

      I get laid off from a high paying job, and I do not get to sue for the emotional problems I have from the loss of my job that I was so good at.

      thats my point...

    Why are people so money- grabbing? I can accept that she might have had an unpleasant experience but its not like she was in danger of any sort. She was not left her there on purpose, it was accidental. Making a complaint is one this but sueing just smacks of greed.
    My daughter was locked in the changing rooms at school by accident a couple of years ago. When she aws unable to get help she rang me on her mobile and I rang the school to tell them she needed to be let out. It was accidental and it never occured to me to complain as things like this happen.

    Did this woman actually suffer any harm? I doubt it.

      I am wondering if anyone can fall asleep, and stay asleep through
      the landing process, and all the motion of everyone getting off
      the plane - I really doubt her story - sounds like she wants to
      blame the airline because she is an idiot. Is she out of a job?
      Is she really suffering like I am being laid off? no, she fell alseep
      like a barby doll, and wants to sue because no one woke her...
      if this is all she has, then she does not have much..she should
      be in my shoes right now...

      The airline was negligent and she was detained and questioned after she woke.
      With that said, if it was me I doubt I'd sue.
      People are to darn sue happy these days.
      If you're not physically injured there's no reason to sue in cases like this.
      I don't want to hear mental abuse or any crap like that either. If something like this causes you mental anguish, that just means your mentally weak and need help.

      I was in an accident caused by the other driver. He didn't have insurance so I tried to sue for just my medical bills and parts to fix my bike. I found out the guy was just divorced and working a min. wage job. I dropped it, figuring he was worse off then me.

              I didn't know if he was rich, poor, or middle class when I contacted the lawyer and told him what I wanted.
              If he was rich I would of had my medical taken care of and would of fixed the bike and kept it.

    I was in an accident once, and was in really bad pain..I did manage to get his
    insurance to pay the bills, but that was all I could get. no atty would even
    look at the case...If you did not loose an arm, leg, or eyeball, then I was
    told just to go-away, it would not be worth their time, but I see some really
    wicked suits going on out there...are you serious? I was injuried, and I was
    told to take a hike, she fell asleep, and managed to find a stupid atty to
    actually take the case...wow...I am just amazed...when this atty finds out
    how stupid this case is looking, he will drop her like a rock....

      I know what you mean though. It seems suing for being stupid, either the sue'er or sue'e is fine. Suing for a legitimate reason is a little tougher.

    They broke FEDERAL law!!!!!!! They did NOT clean the plane, and make sure nobody was there before closing the plane. They are ALSO required to close the gate but NOT before clearing off the plane!!!!! So the airline was REALLY in the wrong!

    It was ALSO false imprisonment!

    And we do NOT know whose fault it is! Was she sick or exhausted by their garbage!?!?!? If so, can they really blame HER!

    THEY broke THREE federal laws! The DHS, FAA, FTC, TSA, Airport, Airport Police, Local Police, and Airline should be breathing down their necks! They should AT LEAST be fined well into the tens of thousands of dollars! And that is even if she NEVER complains!

    NOW, about your job. It was a MERGER! BY DEFINITION that means some people will get laid off. It happens ALL THE TIME, and is LEGAL! There are NO laws against it! As for you doing no wrong, maybe the other was better, or they knew him/her better. Should THAT person have been laid off instead? Should they have paid you to do NOTHING!?!?!?

        I'm talking about laws that have been in place since like the 70s!!!!!!!! They are NOT supposed to leave a passenger on a vacant plane! In fact, they are NOT suppossed to allow people on the plaane outside of the time between boarding and disembarking. It is NOT only a safety, liability, and legal issue, but a SECURITY one!

        Suppose she were a terrorist? This would be a GREAT time to plant weapons, bombs, etc...

        So REALLY... NONE of you would be upset at being left on the plane for 3.25 HOURS LOCKED on a plane and THEN being interrogated by the police!?!?!?!?

        BTW There is NO "SNACK BAR" on the average plane! The CLOSEST you get is a cart, that may be, and is supposed to be, emptied! And would she know which one it is? And there MIGHT be packages, AGAIN they should be emptied, etc... that would be in ANOTHER area. Opening up the wrong area, if it isn't cleaned, COULD present you with a lot of garbage. GRANTED that should be cleaned out, but so should the other things.

        And the pilot area may be locked! I haven't checked to see if there is an actual lock, and MAYBE it isn't true of some of the smaller planes BUT, a few months after 9/11, they started locking them up. And passengers are NOT supposed to go there.

        It isn't like when I was a kid. When I was a kid, a lot of kids were invited up to look, got wings(Like airline employees), etc... But that was like 40 years ago.

        Will it be investigated? Probably NOT! There is a law that was created not long after 9/11 that said that NO passenger was EVER to get up out of their seat within 30 minutes of reagan national airport. I have seen that broken many times, and maybe only 30% of the time did the flight attendant say "SIT OR ELSE!!!!!"!!!!! The law stated that the plane was to be diverted, and the culprit(s) detained and fined $11,000.

        HECK, there is a law saying that jet bridges must be closed if no plane is there. They break THAT rule all too often. One time it endangered the life of a little girl. Her mother chased in to recover her. Her father went to recover them and THEN some IDIOT gate agent tried to act like a big shot and do what he should have done EARLIER. Well, when he tried to stop the father, the father broke the gate agents neck! The gate agent sued him!!!!!!!!! Luckily, the gate agent LOST! But some laws have a legitimate REASON for being there! Their STUPIDITY, and willingess(almost a DESIRE) to break the law could have led to THREE deaths! What if the toddler decided to play with the controls, and lowered the jetbridge? They could have all slipped off the end.

      HECK, I once complained about a delay of a couple hours, and they gave me over 2000 miles. Some airlines don't give peanuts!

    If she wants to get real nasty the airlines might claim that she might have been drunk or on drugs because they weren't ABLE to get her to wake up.........and then counter-sue her for malicious prosecution.

    Dave - That'll shut her up. They'd probably rather have a lawsuit with her than give her more time on one of their airplanes. I sure wouldn't offer that wench more time on the plane - she's already suing for more time on a plane than she was entitled to...LMAO.

      And HOW would the defend against leaving her on the plane? Remember, this is NOT that the failed to wake her up. There was no obligation really to do that, thoough it is stupid NOT to. It is NOT that she was delayed. WHO could claim that? It is that she was LEFT on an UNATTENDED plane, locked up, and left there for 3.25 HOURS! There is a federal law that NO bag is to be left unattended at the airport. This was MORE than an unattended bag in the airport. It was an unattended PERSON ON THE PLANE, and possibly bags AS WELL!

      I can't believe this. She somehow sleeps an extra 3 hours, and you figure she is 100% to blame for EVERYTHING ELSE!?!?!? Frankly, I wouldn't want to fly with any of YOU! You don't take plane security seriously AT ALL! I fly over 2 times each month. THANKS A LOT GUYS! It is people like you that have complicated matters SO MUCH!

        I would have thought a flight attendant would have noticed the woman - but she was in the last row of seats and I don't know what sleeping position she was in.

        Was it an error that no one woke her up? Sure - but apparently no other passengers bothered either. Who sleeps through a landing and unloading?

        Mistakes happen - she is clearly a heavy sleeper and she got missed. The lawsuit is stupid, though. She wasn't hurt - she was quite rested.

        I've had three times when I've been advised to "sue" - and they were real problems. But problems happen and there's something wrong with expecting to be paid any time you are inconvenienced or an error causes a short term pain.

        I'd suggest the airline award her one free ticket and a watch with an alarm.

          I don't generally watch nancy grace. YEP, mistakes happen! THAT is how planes were blown up!

          The watch with the alarm won't help! The airport will get "body scanners", tell her to remove the watch, and the watch will either be STOLEN like taht rolex watch recently, or thrown to the floor like one stupid TSA agent did with my last phone!

          YEAH, I have a malady that causes ME to sleep on the plane, and I generally wake up just before we land.

      Apparently, she was a HEAVY sleeper, and they basically acted like everything was done with the plane. Everyone ELSE was gone, and it was all locked up.

      And WHO KNOWS, she COULD have been a terrorist.

    Like many lawsuits it isn't hard to tell which side should win but rather what the damages should be.

    It sounds like the airliner is liable to me...But how much harm was done? I'd award her $1500 bucks and tell her to have a night on the town to make up for the one she missed. But that's it...These outrageous awards need to end.

    (I bet she won't over-sleep on a plane again.)

    Your right, but the airlines should get HEAVILY fined for this! At least half should come straight from the union, as they effectively act like they own the industry, and without that NOTHING will change!

    Frankly, I'm probably going to go deaf from all the alarms that go off, the idiots operating PA systems, and that huge squeal from buses, just before they leave. What IS that anyway!?!? But the alarms are basically saying "HEY MORON, you didn't shut or open the door, to the jetbridge, properly" They are supposed to be treated as the alarms they are. Sadly, they are treated like car alarms, and often IGNORED!

    Why should taxpayers and flyers have to deeal with the DHS, TSA, etc... if they do things like this that defeat everything. Remember things like this: Man Arrested in Newark Airport Security Breach - ABC News

    Letting this go with no punishment is like giving terrorists a birthday present and saying it is OK to start on the next attack!

        That's sadly happened to many people in the past few years. My one bright spot during this economy was that my sons jobs were secure. But then last year my younger lost a $100k/yr job in a downsizing - totally unexpected.

        He had some rough months but then landed a job he loves - with a BASE of $120k a year. Good luck - hope the same happens to you soon.

    For those of you who didn't read the details the plane landed 3 hours before she woke up - when she woke up the plane was empty and locked and she wasn't able to get out at first. Which would actually be quite the horrifying experience and is sheer neglect of passenger. She has every right to sue

          So WHAT IS YOUR POINT!?!?!? I mean "this poor soul" started going beserk WELL within an hour! WELL within! The person on the plane probably realized in SECONDS that she was the ONLY one on the plane, and it was quiet. THAT means that they have probably been gone close to an hour, MINIMUM! They don't just land the plane and get off. SECONDS later she realized the plane was LOCKED! THAT means that it may be HOURS before the next flight.(The action starts within 15-45 minutes of the next flight) If it were at night time, it could have been a DAY! I mean in SOME places a flight at 8PM may not head out until 6AM the next day. That is about TEN hours! There COULD have been a mechanical problem, and she could have been in the work area. In some cases, that may mean an additional 72 HOURS! In short, she had NO idea if they would be back in 30 minutes, or 3 days!

            You're forgetting that the plane could have been hauled off and used as target practice for the military. Or even a fire drill at the airport, for crying out loud.

            Or a ad for Pepto Bismol could have looped endlessly over the intercom by some twist of fate. And at maximum volume.

            Btw, as someone who has done a lot of traveling and has been stuck in uncomfortable airport chairs waiting half a day for connecting flights to show up I can tell that if I'm sitting on that jury my sympathy level for her will be next to zip...

              well, I have done a LOT of travelling! I generally DON'T sit! I once waited just about a WHOLE day. Delta shut down on 12/23 and never told anyone! I had a flight on 12/25, and they had ******NO PLANES****** going to that airport! They were shut down until 12/26. at the LAST minute, they switched me to an NWA flight! BTW that ~3.5 DAY shutdown was due to OLD 16 Year Old software that was never designed for such a large airline, and that winter storm just pushed it over its limit.

              So you get NO sympathy from me for AIRPORT delays, but we aren't talking about delays! We are talking about being locked on a PLANE!

              That person confined for 41 hours didn't know they would be confined even ONE hour, but got VERY crazy in that first hour. So I don't see the difference. And YEAH, a friend of mine worked in the military and, on the way back from IRAQ, the ENTIRE PLANE was detained so they could film a scene for "major dad". They were SO upset at the prospect and the HUGE delay, that the scene was never even shown.

              So YEAH, anything could have happened. I'm still waiting to really hear your point though.

                    GREAT!!!!!! PLEASE tell the TSA and DHS about that, and try to get all this garbage overturned then. I mean if you are going to connect a sewage line through a hole in the roof, why worry about keeping the place clean, etc?

        It wasn't the fact about sitting in an empty plane if you read carefully she was locked in - and I don't know about you but often when I go on planes I fly someplace where it is a different cellphone provider and difficult to get signal - she had to wait on the plane for someone to get her. God knows when they could have come by - she could have been there for sometime after she woke up waiting on the next flight. Some planes sit in small airports for days. That is a horrifying thought if you were the one locked in the plane

        Also the other crucial point is she may have had a deadline to make which was disrupted by the neglect of human safety and policy. Such can not be over looked.

            Well, I can't watch THOUSANDS of people! I pay OTHERS through taxes, fees, prices, etc... to do that! What part escapes you that THOSE people should DO THEIR JOBS!?!?!?

            we DID assign people! THAT is what the DHS, TSA, airports, and airlines are supposed to do!

              Here's the deal...It wouldn't surprise me one bit if after all the smoke clears it turns out the woman constructed this scenario. Am I saying she did? Of course not. Am I saying it is completely within the realm of possibilities. Absolutely.

              If it turns out she hid in the restroom until the coast was clear don't be surprised. People that will initiate a lawsuit the same day they are 'wronged' are a little too coniving for my taste.

              Recent history is way too full of these people.

    How on earth could she sleep through all of the pre- landing announcements and the flight attendants going up and down telling everyone to put their seats upright and the last minute rush of everyone going to the toilet and the last minute duty free trolley dash and the sensation of losing altitude and the bump on landing and the scream of the reverse thrust of the engines and the force of the reverse thrust of the engines and the noise of passengers getting their hand luggage down and shouting at the kids and the flight attendants telling everyone to have a nice day?

      Well, the announcments, she probably had EARPLUGS, or the announcer had an IQ over 80! The later is RARE, but it happens! Maybe she and the people next to her were SKINNY! ALSO, on some LARGE planes there may be a couple exit rows that don't recline. The toilet and trolley are all too quiet. Losing altitude doesn't affect some people. It doesn't affect ME! Sometimes there IS no bump on landing, and it is usually FAR from violent. The reverse thrust is only on like one plane, and not always used even THEN, and it is usually quiet. The passengers aren't necessarily noisy, and there aren't necessarily kids. And SOME kids are QUIET! The flight attendants usually only talk to people, IF they do, upon LEAVING. Still, most could be explained by earplugs, and she might even have been deaf or hard of hearing.

      The person in the aisle is the one USUALLY stepped over. Still, she may have been the only one on that side. In fact, on some smaller planes, the A seats are window AND aisle!

      I DO agree she must have been a SOUND sleeper. Sickness or exhaustion could explain that.

      BTW it implies this WAS a small airplane, so NO reverse thrust, and a greater chance of a window/aisle seat!!!

      I said SOME! I was on one flight with like 2 babies and a jerk that was perhaps 7. The babies were quiet but I wanted to STRANGLE the 7 year old. He SCREAMED YEAH, were off............. And when we landed he did the same, and he was so noisy the whole time it was PAINFUL! but SOMETIMES....

    This reminds me of a story my Dad told me about when he was in the RAF just after WW2.
    Can't remeber the exact details of location etc but anyway my Day had been on leave on was on his way back to to wherever it was he was stationed. He fell asleep on the train,missed his station and eneded up at the end of the line. So he just sat there until the train pulled out again.
    But he fell asleep again and missed his station on the way back. He got off and got onto the train going back where he had come from...but guess what, he fell asleep again. This went on until he had passed his station several times. He did eventually get off at the right station.

    He reckons that he knew he had missed his station each time cos there was a goat tethered at the staion after the one he was meant to get off atg so every time he saw it he knew he had missed his stop. God help me if I am a genetic copy of this man.

    Yeah, I heard about this on the news. It seems if you sue you will get some money no matter what. The insurance companies prefer to settle if it comes down to it. Sueing because you fell asleep is just ridiculous. But thats the age we live in.

    I was "trapped" in the "no-Visa" room in the New Delhi airport for 18 hours (not by my choice) on the way to Nepal. Not only could I not leave this tiny, extremely crowded, noisy room, there were literally armed guards keeping me inside. It truly was short-term imprisonment - yet I just sucked it up along with the other travelers stuck with me.

    I'm 100% certain I could get out of an airplane MUCH easier than I could escape from that room.

    Her greed is effecting her judgement.

      Did you have a visa for nepal? Would you have had a lengthy stay in india? Although India has benefitted a LOT from the US, and shouldn't require visas for short stays by americans, apparently they do! NEPAL requires one but says you can get one after the significant(2-5 hours) delay!

        Yeah. We had Visas for Nepal, but since we weren't supposed to have a layover in India, we didn't get the (expensive) Indian Visas.

        The crazy thing is that on the way back we got to go to the main waiting area, and it was very modern, clean, and even comfortable.



        Unrelated story for you, Steve, since you have some knowledge of airport security:

        On the way back from Nepal, my son had 30 pounds of rocks in his carry-on backpack. I'm sure Sal wouldn't need an explanation, but for the rest of you, he's a rock-hound.

        In New Delhi, there are armed guards in abundance at every security checkpoint - with very visible machine guns. The station where our carry-on bags were scanned was no different.

        I placed my backpack on the conveyor, and it went through the x-ray machine with no problem. When his backpack was passing through the machine, the technician backed it up under the monitor, then called over a supervisor for advice.

        We were then escorted to the side where my son had to pull every item out of his pack. The three security guys could not understand why he had a pack full of rocks. After several minutes of very heated and very confused conversation, they called in a higher-level supervisor (all of this was done with the observance of machine-gun-armed guards). The supervisor spoke a little better English, and when my son explained that he collected rock as souvenirs, the supervisor chuckled and then explained it to the other guards who all started laughing.

        This extra attention led them to put a special tag on his backpack. Two more times on the way to the airplane we had to completely empty our bags for some very serious armed guards. It was pretty tense.

        After returning to the US, I learned that Nepal has serious problems with precious stones being smuggled out of the country. I suspect that this was the source of their concern. Regardless, it was the most hairy situation on our trip. Considering that it was just the two of us and that we went into some very remote areas in the Himalayas, that's saying something.

          I can't imagine anyone not understanding rock collecting. HECK, near the mexican border there are a lot of rocks that might be rather plain, and even your son might consider them rather devoid of value, but they are smooth and rounded, and somewhat consistant. I'm sure the kind of subtle beauty of that is what led a guy to take them put them on some hay in a little box, and sell each one for a few bucks! YEP, the "PET ROCK"!           Of course, there are some rocks that look kind of ugly, cut them open, and the inside looks rather nice Geode - Wikipedia, the free encyclopedia etc...

          Yeah, I figured you had a problem due to a layover in india. I STILL say they should be nicer to Americans! Heck, last I knew, most of western europe allows Americans to stay for 3 months WITHOUT a visa! India should give us the same courtesy.

      Well, the DRIVER is the only one in that case REALLY. They SHOULD check before they go to the depot, or whatever you call it. Sometimes they FAILED! BUT, THEY don't deal with security, like the airports do.

        Security or not, the flight attendants failed in this case.
        A normal person can deal w/ things like this. But I think most 6 or 7 year olds left on a bus would wake up a little more panicked.

        Think I'll drive to McD's for a hot coffee. That might payoff.
