Warriors should I really resort to this on eBay?

So I bought a phone off eBay because my old phone was starting to act up and I couldn't upgrade until January. Anyhow, bought the phone, got it activated until I started having reboot problems.

My phone is constantly rebooting on its own no matter what I am doing and upon further inspection, a lot of other people have had the same problem. I've been running back and forth from the phone store and chatting with them on chat for days now and I am getting frustrated. I've already threatened the rep to cancel my contract because they couldn't do anything to either phone even though they were both acting up and they refused to provide any further help. Plus they were charging me $10 extra a month for a service that's not available to all networks.

They did tell me since the phone is in warranty, I can go down AGAIN to the store and have them repair or replace it for $35

I'm at the final straw as I contacted the seller about it and told them what's what and that I needed a refund even though their page mentioned they don't have returns.

I don't really want to but I may have to use the eBay Protection Policy because this is creating more trouble than its worth and I just want a phone that works.

Question is - should I go that far and do it even though I've contacted seller and told them what had happened?

I don't want to sound like a serial refunder or anything, but the phone's not working properly and my carrier is doing little to fix the issue despite a growing number of people complaining about it.

    Phone problems can turn out to be nightmares. I could write a book here.

    Just do what you need to do to get satisfaction. It was a business decision for the eBay vendor to sell the phone, it was a business decision for the phone company to offer it or the service, and it needs to be a business decision on your part that you CYA.

    There's nothing personal about any of this. Do the right thing here. Take care of #1 and do it with class. Don't let it get personal, and don't take no for an answer.

    Thanks. I can already tell just from these past few days that they're a nightmare.

    I'll give them a chance to respond to my latest email and then move on from there. Hopefully this will be over soon.
