BBC News - Megaupload file-sharing site shut down

what do you think about it?

Megaupload, one of the internet's largest file-sharing sites, has been shut down by officials in the US.

The site's founder have been charged with violating piracy laws.

Federal prosecutors have accused it of costing copyright holders more than $500m (£320m) in lost revenue. The firm says it was diligent in responding to complaints about pirated material.

    According to a story on RT.com, the hacker group Anonymous is taking down some major websites in retaliation for this. It's interesting that this hasn't even been mentioned in any U.S. run media. Of course, I'm not even sure it's true, though I kind of hope so

      Yes, makes sense. Introduce 'problem' SOPA legislation, get 'reaction' with 'anonymous' retaliation, and justify similar legislation as the 'solution'. Got it. I would think those 3 entities named might have something ($) to gain from this, no?

      Bottom line? It's the duty of the property owner to provide adequate defense and security of their own hosted web property, especially those with the monster budgets to do so. ALL debate begins and ends right there.

        You have a point. They have pulled such garbage SO much lately that I am surprised anyone believes ANYTHING!

      YEP! A LOT of *****IDIOTS***** say that the current laws don't allow for the internet, etc.... *****BULL***** the laws were written a hundred years or more ago! They did NOT say ONLY books, or ONLY films, etc.... In fact, they PREDATE film, and handled IT fine! The concept is MILLENIA old, and THAT is what the idea of copyrights, trademarks and patents covered, the CONCEPT!

    What is disturbing about this is MegaUpload is based in New Zealand. It seems that the whole world now falls under US jurisdiction.

    Imagine if the New Zealand authorities shut down and seized the assets of a US entity because what they were doing broke NZ laws.

    I'm not happy about the way the US authorities treat American citizens, and furious that they can apparently treat citizens of another country the same way. A friendly nation at that.

    Way to go about winning hearts and minds.

      Was their IP address 174.140.154.23?

      If so, it looks like it was hosted in the US. The US DOES have jurisdiction against sites in the US even if it IS bordering on ILLEGAL to do so.

      I agree with everything else you said though.

          Um...they were arrested by New Zealand officials at US request. The US can request this, as New Zealand and many other countries can request of the US, because of copyright agreements between the countries. Seems to me the Berne agreement is working exactly as it was intended.

          Am I missing something?

    At least one LOL has come out of this. Apparently one of the authors of SOPA, Lamar Smith, has been busted for using copyrighted images on his own website, thereby making Worst Person In the World on Keith Olbermann's Countdown show.

      I don't normally agree with that guy, but HERE I do.

      And there is *************NOTHING************** that lamar can do to defend himself! NOTHING! Why don't they just lock him up for 20 years! There are only like 4 possibilities! Just FOUR!

      1. He KNEW! He is GUILTY, LOCK HIM UP!
      2. He got it from another source and believed it was OK. SOPA/PIPA says he is guilty, he wrote it such that innocent can be found guilty, he is even MORE guilty than #1, LOCK HIM UP!
      3. In some way there is a misunderstanding, see #2!
      4. He is "innocent", it just LOOKS very much like that photo or some such, see #2!

      As the author of the bill, PASSED OR NOT, he INSISTED that he be locked up, so PLEASE, DO SO! SERIOUSLY!!!!!!!!! HEY, do that with EVERYONE that wrote it, modified it, or voted for it that broke their law!

      BTW many lawyers consider changing things like this to be a sort of obstruction of justice. The person could STILL file suit!

      BTW the stupid SOPA supporter on PBS claimed that this could NOT happen! That a person could not find their site down for such a simple reason. OH YEAH, WHY is his site still up?

        His site is up because there are no violations on it. When the person who looked at it couldn't find any - she went to wayback machine and found a version from 2011 (apparently that's the year) where there appears to be a copyright violation.

        But - we don't really know if there was credit given or not. It is assumed "not" but then again - we don't know how long the site was online - who built it - or whether it was changed to avoid copyright infringement.

        It's a funny charge right now and great for media headlines - but it may not have any legs.

        Comments like that concern me - why would you hope a hacker group is attacking websites? Isn't that another form of censorship? This group hides behind fake voices and masks talking about freedom and lack of censorship - and then they decide who gets to be free? I think they showed true colors today.

    Why does everybody always 'throw the baby out with the bathwater'?

    I agree SOPA/PIPA will be/is a bad idea and it needs to be tabled permanently. You see they are ALREADY able with existing laws to do exactly what everybody is so paranoid about those bills enabling?

    However why is nobody concerned with copyright infringement and fraud - like the pirated software, fake watches and numerous other rip-offs that need to be stopped? At a time when we really can't afford it this country is systematically ripped off for all sorts of 'intellectual property'. We are losing billions to THEFT, PIRACY AND LARCENY. hello??

    ... and it is high time that the US stopped being ripped off by other countries. In concept (hahaha) laws are to protect the citizens - ok - so what if you are in NZ or wherever - if you rip off an American citizen or corporation then our government should be able to run interference for us.

    There is no running back over the border to evade prosecution when you commit a crime. and millions and millions of dollars have been lost to fraud on the internet - it is like the wild west where creeps and crooks know they will probably get a way with it so why not do it? All Americans are rich anyway, they can afford it right? hahahahahaha NOT..

    We need some protection - how about the other side of the coin where another couple million people assume "Internet' is synonymous with 'fraud'. How's that doing to help you promote your online business?

    ... but again before you byte my head off, I don't agree with the way these bills/laws are so arbitrary or the fact that they can shut you down just by accusation rather than after being proven to be guilty - It smacks of lots of things too nasty to mention in polite company (LOL).

    ... and further anybody that supports hackers for any reason is just plain stupid and I hope you get hacked and see how you like your personal information splashed all over the place and your site defaced.

      We ALL know that! HECK, my INDUSTRY relies on IP, etc... I want CREDIT for everything I write for customers, etc... But there is NO way to properly enforce it, so without an abundance of evidence, there should be no conviction! SCO once tried a trick to OBLITERATE LINUX! Actually, they tried TWO! Once, they added some lines of code to a linux they released, and later came back claiming copyright infringement! According to reason, AND the law, they made that code PUBLIC DOMAIN when they released it! ANOTHER time, they bought a license, and then tried to recall the license granted to all others. They ACTUALLY INSISTED that ALL ISPs with Linux pay THEM a licensing fee!!!!! AGAIN ILLEGAL, because the previous owners grants of rights trumps THEIRS! The owners simply no longer had the right to sell! STILL, it went through the courts. They lost after the seller said that right was not included! And we ALL know of PD sites offering copyrighted stuff as PD! That said, if I give a document to a customer, and they release it with no credit, or A PD site downloaded stuff THEMSELVES from a site that had IP stuff, THEN they are GUILTY.

      I believe NZ IS one of the countries that signed the treaty that says THEY will honor such things. MOST countries did. Likewise, the US honors THEIRS. BTW China did NOT agree to it!!!!!!!

      I agree with you! I think we ALL do! But this IP garbage goes TOO far! I mean YEAH programs should be copyrighted! Maybe SOME code should be patented! But one company wanted me to LITERALLY sign away EVEN the rights to "A+=1"!!!!!!!! IMAGINE if a company said you couldn't say or write "I" anymore, or some such. INCREDIBLE! ONE person apparently patented the way to make a speaker make a sound! One person patented the easy way to change a pixel on a screen. Amazon patented one click ordering. One guy, in australia patented the WHEEL! Those things should be WIPED OUT! They are NOT valid patents!

    It will force the issue of theft to be taken more seriously by those who abuse others rights though even if it does not go to court all the way. At least I think it should to help those who work hard and then have it scraped away by those who did nothing to earn income from it.

    When they introduce bills like SOPA, they are NOT asking for permission, it is their way of letting you know the infrastructure is already in place, and they will go ahead and do it anyway.

    It's the governments way of sending out a press release. Just a formality.

    All the bickering and political fighting is not about should it exist, but who will control it.

      There are legally like 4 levels of law, in the US!

      1. Constitution.
      2. LAWS.<<<<<<<<<
      3. Precedent. So previous court cases on similar matters facilitate new ones being judged the same way.
      4. Things logically derived from them. So the internet is STILL subject to copyright even if not specifically mentioned.

      The stuff in SOPA/PIPA is NOT in the constitution, NOT a proper precedent, though THEY are decided in the courts, and I doubt it is a law. Sopa and pipa want to MAKE it a law.

      The infrastructure ISN'T in place. They merely have someone with the color of law intimidate the people that can do it.

      BTW, last I knew, the current law provided for the removal of copyrighted items and ***IF*** the site was obviously one to provide/encourage such violations, or guilty of multiple ones in the past, ****THEN**** it could be shut down.

      This is a complex issue. The fact is, it would be impossible to stamp out piracy completely in the digital age without creating some kind of global fascist state. I'm not pro-piracy -I create content online and don't like it when it gets stolen. But I also recognize that it's very hard to stop.

      I think that the internet and the Information Age represent the beginning of a completely new world when it comes to concepts like property. As the REM song that someone posted says, "it's the end of the world as we know it."

      I'm also suspicious of the tendency to see large corporations and rich nations like the U.S. as victims in the overall scheme of things. Sure, pirates are low level scavengers. But the global economic system is designed to protect large corporations, not individual artists and small businesses and you can be sure any legislation that's enacted, whether SOPA or anything like it, will reflect this.

    The bottom line is that we are going to need to introduce new cyber laws to protect vulnerable industries like film and music. We all have had a good run on the piracy train but we have to come to terms with the fact that it has to end sometime. SOPA is not the answer, but we do need an answer.

    Remember, it is rarely the big movie and music stars who are getting hurt here. Its the crew, the engineers, the sound people, the unsung heroes of these industries who take the pay cuts.

    The one thing I really can't stand is when people are profiting off of the piracy industry itself. A pirate making 43 million a year or whatever deserves to go to jail for the rest of their life.

      The film and music industries have had over a decade to adapt their business model(s) to suit the new technology and have decided they would rather stay the way they were and force the rest of us backwards to suit them.

      Piracy has been going on since forever. When cassette tapes first came along, record companies were claiming the sky was going to fall down. The same from movie studios when videotapes became available.

People now have access to what they want, not what the suits have decided will make the most money for their shareholders.

      Everyone on this forum should be well aware of the concept of niches. Just about no-one (that I'm aware of) on WF has been successful on a mass market level. There are however many success stories of people who have found a smaller market and sold products specifically tailored to those markets.

      Adapt or perish.

      I have screamed this for over 30 years, I guess I should repeat it AGAIN! There is ******NO****** way to "protect" such things from pirates, and ANY attempt to do so hurts the INNOCENT! The industry FINALLY realized that a bit over 20 years ago, and GAVE UP much of the MORONIC copy protection! There are LOTS of laws on the books! About 30 years ago, the software industry created a policing program. They pay people to anonymously tip them, and fine the crooks, and throw them in jail. Their motto was "pirate software, and get this new piece of hardware!". The hardware was HANDCUFFS!

      And YEAH, the big stars often get a BIG advance, high salary, AND a piece of the profits. It's incredible that the companies put up with it. They have to make a HUGE profit just to break EVEN! Music stars, and writers, get paid up front, and residuals. The main crew, engineers, sound people often get paid with the work. The people that get hurt initially are the production companies.

      For software, a company like microsoft USUALLY pays the people that worked on it, and THEY get hurt if there is piracy. If I write a program, and release it, and IT is pirated, I get hurt. BTW REALIZE that if the film companies get hurt, it could hurt the future of that company, and reduce output which THEN can affect ALL stars, INCLUDING the big ones. If microsoft is hit, it will ALSO often trickle down.

      But you are looking for an answer? I HAVE IT!!!!!!!!! I have the SOLUTION! I have screamed IT for over FORTY years! It is ***THE*** solution!

      Think of it!

      2. The END of wars!
      3. The END of inflation!
      4. The END of conspiracies!
      5. The END of poor education!
      6. The END of working unto death and seeing no return!

      ALAS, I have come to the conclusion that it may NEVER happen! AND, as I stated in another thread, if it DID happen, it would take DECADES for people to believe it 100% and, until they did, the full impact would not be realized.

      If you are looking for another solution to piracy, FORGET IT! Ironically, TUA would probably mean FEWER films, and most would probably be dirt cheap. HEY, paradise WILL mean that people would give up some things they now perceive to be positives. And WHY would a person with TUA remake a good film?

    This is really sad, I don't know the extent of what they did or didn't do, but I know they did take down uploads if they received any complaints, no different than any other company. What happen to lawsuits? What's this no due-process guilty before proven innocent stuff about? I thought it was suppose to be innocent before proven guilty?

    I think this is terrible and now i'm wondering how long it will be before youtube and sites like it go down. Another thing i was thinking about is how will we continue with our businesses? Google has so many Copy Righted material that it's no way it will not get accused of breaking this law cause of some greedy individual that see an opportunity to "get their fair share of the pie".

    We all know Google has millions and that will just make them a complete target! I believe this has nothing to do with money cause they make it literally, (even though it is against US Constitution Laws to keep printing at the rate they are doing it) this whole "SOPA" thing is about control, they can't control it cause it is way more people contributing then there is trying to contain it.

    We all know "bootlegging" has been around for ever and so you telling me now yall want to try to stop it? The Government could have stopped this a long time ago but they had more control over it... Now it just got out of hand so now they're gonna do what they gotta do to gain that control again... This is not good people if you see what i see coming!

    Apparently MegaUpload was being sneaky when conforming to DMCA requests to take down copyrighted material. They were removing the links pointing to the copyrighted material but not actually removing the files from their server, which could still be accessed via other links that the copyright holder hadn't found and reported. And of course, they allegedly paid users who they knew uploaded copyrighted material. If all this is true, I can't say I'm sorry to see them go.

    A pity about all the legit files that were being shared there, though. Hopefully legit users had backups of their files elsewhere.

    Youtube and other sites that conform to DMCA notices properly should be safe (at least for now) from such takedowns...if that really was what Megaupload was doing. Oh, and this definitely shows SOPA & PIPA are not necessary at all.

    I had never heard of this site till yesterday either.
    Do not think that someone making millions off of 'stolen' goods, is good for anyone in the long run. One of the reasons for all the proposed legislation and regulations are because of people like this, obviously.

    A little more on the founder of that site...42 million $ in 2010 alone...

    Megaupload is gone? That is such a sad story. Megaupload had served as a big help for countless Internet users all over the world. They made life easier for us online. Now that the US government shut them down, it would certainly be difficult for us to access files easily and quickly. Anyone who can suggest another friendly site the same as Megaupload?

      For essentially backing up to a cloud system, you can try Dropbox.

      For basic file sharing, you can try Rapidshare.

      I would have recommended Mediafire, but after Filesonic and Fileserve essentially decided to stop their sharing services, I have a hunch Mediafire won't be far behind.

    I find this interesting..

    Heres my take:
    They wont be able to do anything with him because he has a lawyer from the white house (Go figure because the USA wanted him). When you think about it they didnt do anything wrong on the megaupload.com site. They didnt advertise anywhere saying that "Hey upload your music and movies here" You know. It was everyone else that uploaded too the site and allowing everyone else too download from it. I feel this was a sence where the company grew too big too fast and he didnt have a system in place too stop people uploading music and movies and whatever else.

    It is like shutting down youtube because people are using music we are all using in the videos and we all saw that happen and youtube just has a system in place now. I think this is what megaupload will do.

    Conclusion:
    He will get a mega fine and he will have too put a system in place too stop this happening again. They will be keeping a very close eye on him.

    It is on the news every night down here in New Zealand and he is trying to get bail at the moment to spend time with his wife and 3 kids (Wife is pregnant again wow).

    That is my take. I don't want too piss anyone off by saying all this, It is just thoughts i have been having over the last few days. That's it.

    They seized ALLOT of money tho, unreal that kim dotcom got so much money from the net tho. Amazing.

    sad but completely true, we can expect this things to happen, soon we will see a lot more of restrictions on the internet from several other govs.. despite the web was made for military activities it became the tool of the masses, the voice of the world, you cant just shut up the web overnight because the internet now belongs to the world..
