    Another indication America has gone to crazy.
    You know, some thing people don't need to be told. But to be honest,I'd say the widow is making this up.I've seen several cardiologists and numerous nurses and not only did they all tell me not to get too physical ,it is also written on almost every piece of paper that they give you beforehand ,not including the fact that if you have suspected heart problems you,just common sense say don't engage in possible dangerous activity.

      You're right either the widow is making this up or the article is missing key pieces of information that the jury had access to.

      Like the woman who sued McDonalds for the hot coffee. All the media said was that she spilled hot coffee in her lap. People talked about that old woman like she was a dog. Never seeing the 3rd degree burns or reading the reports about McD's other burn victims.

      I thought the threesome story was funny but I doubt this is all there is to it.

    GEE, if I were a jurer or judge, I would have said....

    "Do you HONESTLY expect us to believe that your ENTIRE circulatory system was REPLACED with a brand new one? You REALLY believed that the technology exists and was discovered?"

    I mean SHORT OF THAT, it is a GIVEN that exertion could cause a problem.

    HECK, my father AND I BOTH had a severe drop in capability after the operation. NOT ONLY does that tell you that it ISN'T new, but gives a taste of what could be, etc...

    If he felt good enough to have a three way, I would say it looks like the doctor probably did a decent job and shouldn't have to pay a PENNY!!!

    This is like having a 10mph accident, and suing the car company because there are dents!

      I have chest pains - I'm scheduled for testing to see if I have heart disease...oh, wow, I think I'll to a three way.

      And that's the doctor's fault? No wonder med costs keep skyrocketing.

      I can see a new wave of doctor warnings:

      Don't pull out the stitches
      Don't pick the scab off
      Don't hit your head again
      Don't play tennis with the cast on
      Don't run a marathon while wearing the ankle brace
      Don't go the gym until we know if you have a bad heart

      It's true - you really can't cure stupid...but you can blame someone for it

              Yep, we're taking natural selection right out of the picture. It used to be that stupid people just ended up killing themselves somehow. Now we are so protected from EVERYTHING that stupid people are breeding instead of dying. We are not only becoming over-populated - we're becoming over-populated with sheer morons. And they are everywhere. They are even getting into high level gov and corporate offices. It's not really a good idea to mess with nature.

          His wife sued for workmen's compensation, because he was "killed on the job" - and won a large settlement. :p

      It is the jury who needs a psychiatric examination because they believed in all the junk put forward by the plaintiff's lawyers. It is likely that the lawyers will get a big slice of the compensation.

      It is completely unthinkable for any doctor, let alone a cardiologist not to warn a patient with chest pains against taking strenuous activity. In this case, it is basically the doctor's word against a patient who is died. How would the patient's family know that the patient has not been warned. For all I know, this could be made up completely by the family.

  • Let's see...had chest pains severe enough to go see a doctor...saw the doctor and he set me up for a battery of tests...but he didn't tell me to 'take it easy'...
    (maybe he assumed I would - but he didn't actually tell me :rolleyes

    This part also cracks me up, and also from the Gwinnett County news:
    Attorneys at Edmond & Lindsay in Atlanta couldn’t be reached for comment Wednesday, The Journal-Constitution said, and it was unclear whether Martinez’s wife or his two sons would be benefitting financially from the judgment.

    Who benefits? Did the wife actually file the suit? The guy wasn't in very good shape for a 31 yr. old...but he's only "40% responsible" (they were actually awarded 5 mil, so they only got 60%) what a load of BS.
