Registering a Business

It's come to my attention that when selling an offline service the buyer might find it a little fishy if they have to address their check directly to my name, so I need to not only claim to be a business, I need to take the legal steps to register the business so that I can then open a bank account in the name of my marketing company.

Might anyone be willing to share how I should go about doing this in Texas?

    It varies by state and even city. Call you city or county clerk and they should be able to tell you what to do to register as DBA(doing business as).

      Hello. I'm in Texas.

      Aaron is right. Call your local County Clerk.

      You will file a Fictitious Firm Name certificate. Some counties have the forms online. It needs to be signed and notarized, file with the Clerk. The fee is minimal, if I remember right, around $20.

      When you get the filed-stamped copy, you can take it to your bank and should have no problem opening up a business checking account.

      If you want to use your SSN to report income, etc., you can. Another option is to apply for a separate employer tax ID number (IRS SS-4 Form). You can get the employer tax ID number over the phone with the IRS in less than 30 minutes or you can apply for your tax ID number online.

    If you google "Texas department of revenue" or of that sort, it should take you to the official Texas site in which you can check the steps on how to file a business entity. Many states can just have you file it online now - so it'll check their database and ensure that the name you want to name your company does not currently exist. It's simple, just ensure that you have all the proper legal documents and tax work in order. It all depends on what type of entity you want to register. I highly recommend LLCs.

      Always start with the county....it's the simplest way to go. Any bank will open a business account with a dba or fictious name certificate.

    I'll give it a shot and if I fail then I'll shoot you a PM. I've found the form online already and it's going to cost 40$ for the application fee itself, but that's more than fine by me to get the ball rolling.

    I am in New Mexico and the state of New Mexico does not require a DBA to register the name, it is one of the few states which does not.

    So can anyone tell me how this would work with a bank? I need to get set up quickly.
