  The reason they are still #1 is probably because if you look at 'Belleville Defense Attorney' stats in Google's Key Word Tool you will see a - next to all the monthly search traffic stats.... As this is phase 1 of the Google EMD update (soon to become a quarterly or even monthly occurrence) Google has nothing better to place above the result as IT believes really no-one is that interested in, or searching for 'Belleville Defense Attorney'.
  
  Next time round they might not be so lucky.
  
  If you create a site now with all the correct title and H tags with Geo references and other key ingredient and half a dozen good pages of content you would wipe them straight off #1 as soon as the EMD update revisits if not before.
  
  That said if they were genuine (and not just a Joomla login page) with a good linking profile and reasonable bounce rate they would keep their spot.
  
  I have found it relatively easy to rank and stick following these 10 steps:-
  
  1). Use WordPress (because it just works so much easier)
  2). A minimum of 6 well written relevant pages
  3). All tags correct with the keywords in the H1 and Title (it does make the difference) and unique titles and descriptions
  4). Install Yoast SEO plugin and USE IT! no need to pay for seopressor yoast is just as good.
  5). Home - Privacy - Disclaimer - Contact - + Content Pages
  6). Google + & Google Web-masters account & Google Analytics all set-up for the site
  7). Sitemap, sitemap, sitemap! Video as well if you have some.
  8). KML & GEO Site-Map (for local sites, knocks the competition out easier, go to geositemapgenerator for an free easy one)
  9). Create Business pages/accounts with the top 4 Social Media sites Twitter, Facebook, Linked-in, YouTube and then add Google+ for your Places listing etc - then go to Fiverr and get a promo video done for $5 and go to flixtime to create another one of your own. Add these to YouTube with your site URL at the start of the text and your address as displayed in G+ Places. Add your profiles to all the other social media accounts with the URL of your site and make a few friends and posts, just a couple to get things going
  10). Now (before you get your G+ PIN to activate it) go to as many GOOD on-line directories and register the same details with as much good info as possible.
  
  Using these basic 10 steps I have sites on within hours and ranking on page 1 within a week, generally Google takes about 4 to 6 weeks to fully trust you and after that your position will settle then you can work out if you need to start more linking and within 6 - 8 weeks we generally get P1 and stay there, total cost $30 and about a day's time setting up and completing all the details
  
  We do a little more optimization on the images and tags however nothing crazy or wild! Don't believe the hype

That's only if the site fails based on other factors as well. If what you're suggesting is true then NYPD.com, or nytimes.com would be forced off the first page because people were searching for them in Google.

Value (or lack of value) is still the reason for the EMD's you're talking about losing their footing in the rankings like: worthless over-optimized content, low page count, valueless links, etc.

It is that if the Keyword are in our domain and site is not so well,content is not so fresh and unique and linking building is Not so proper then it will not be shown in Google.Named EMD.
I has some difference from Penguin update.

After doing a lot of checking we're still finding a lot of EMD's on page one. So it leads me to believe that the change is just an algorithm change rather than a penalty.

So it looks like Google is no longer giving extra credits to EMD's. Which may or may not be effecting your current ranking for your primary keyword.

As I see it you have three options if you have an emd:

1) Keep on keeping on like you have been. Every time you submit a new link it builds up your domain authority. Which of course will help it rank for other keywords. Eventually when the authority gets high enough you may even be able to rank for your primary keyword down the road.

2) Swap out the primary keyword you're trying to rank for on your index. This would be smart if there were in fact a penalty levied against your site for your keyword since it matches your domain. I don't think it is a penalty but I could be wrong.

3) Republish your existing site upon a brand new domain. This will involve transferring all of your existing content from the current domain/hosting server to the new domain/hosting server and configuring 301 redirections for pages on your current domain in order to prevent content duplication penalty. This is actually a much simpler process than it sounds, albeit somewhat time consuming.

Brace yourselves as google releases another algorithm update for TOP HEAVY this week. A lot of affiliate sites will surely get hit by this as it aims to take down sites loaded with ads and bearing less content.

There is a reference about it on searchenginewatch (although I've subscribed to Matt Cutts' twitter feed where I read the update).

The new algo update began rolling out on October 9.

EMD is the worst one than Penguin, if we are affected by penguin we can change our content and etc but if we are affected EMD we have to change the domain.

Not at all Matthew you just need to do a good review of your on and off page factors, clean-up and build a bigger and better profile off-page.

First check who's linking to you at opensiteexplorer.org or something similar and see if you have a load of poor links back at you, then look at improving on what you have out there and gaining more quality off-page real-estate.

Also review your on-page code, if its the website in your profile there is over 30 H1 tags on the home page this might not help you although it's definitely not the only thing by far that will impact your ranking there are many other things to consider.
