Offline Gym Lead Generation Box Question

So I was looking up information on putting up lead boxes to generate gym clients. This guy had an interesting strategy for partnering with businesses (you need the business' permission to put up the box obviously).

He says to offer the business owner free gym training, and an affiliate commission for every person that signs up, which I think is a great idea. But he also says, that if you have 25 lead boxes, that you will share all the lead info collected from all 25 boxes with all of the owners. So if you collect 400 leads a month, all business owners have access to the list in order to market to them. I wasn't sure on the legality of that.

For instance, with the email addresses that you collect for each lead, you can't just add them to whatever restaurant autoresponder list right? Just because they entered their name into your lead box for a gym giveaway, does that give the restaurant owner permission to add them to his email list? And 25 different restaurant email lists at that? Do I need to have some sort of disclosure? This is what I'm confused with.

    I dont know how he does it but I would put that disclosure on the entry form.
    Ie they accept to be on OUR list which will be worded as a free subscription to our fitness newletters that includes fitness tips, recipes and such and can opt out at any time.

    I would also send them a newsletter with local biz offers once a week or every other week or just include the room for sponsor on our newsletter blast for our partners.

    I would not auto opt them in to a bunch of other lists.
