selling leads to professionals -- patient/client privacy

If one is selling leads to a medical practitioner or a lawyer, especially where you use a tracking number to forward the calls and record the calls so you can charge per lead, would that fall under things like HIPAA and various other information privacy laws, i.e., abuse of private patient or client information?

    So if you're recording the lead call for a doctor or lawyer or the like, could that cause problems in terms of patient/client confidentiality laws if it was found out the doctor's or lawyer's lead service was recording the calls. Any thoughts?
