Suggesting vs Guaranteeing results

I'm going to start getting clients for local businesses soon. I'm taking into account that you never guarantee a specific number of clients (IE: "I guarantee you'll get 300 new clients once the cycle's through"), only your own actions.

If I were to tell a business owner "I can get you 300 new clients, and that's a huge ROI for you," does that "can" count as an implied guarantee? Would a person get in trouble for saying it and delivering less results?

    If you say a number and don't deliver yes it could be an issue.

    A few things to think about.

    1. Always under promise and over delivery - Pull a Scotty
    2. Never use your numbers always use theirs

      The way I understand it, that would suggest like a 10% increase on their current clientele, which could still be a risky claim. I don't think I understand; could you explain this point?

    I am sending out a direct mail campaign to businesses with websites.

    Our service? Web re-design
    Our guarantee? We guarantee we will beat the amount of leads coming through their current website with our new re-designed website.

    Its sounds a little risky but here is some contingencies:
    -They must provide the data to prove how many leads are coming through their website [on average] per month.
    -They must must provide the data to show how many visitors are coming to their website [on average] per month, and where they come from.

    If they cannot/won't provide that data to us then we can't guarantee anything to them. But, on the bright side, that guarantee in the sales letter pushed them to be able to make the phone call to us in the first place, and we can still acquire the sales and convince them to purchase our services anyways.

    If they do provide us with the data and we create them a new website that does not beat the amount of leads coming through their old website then we just re-test different aspects of the site until it does beat their old website.
