You have to deindex the old site first. Once that is done, copy the articles to your new site and you won't experience any issues unless scrapers have copied and pasted your articles onto their sites.

Had this issue, what I did was move the content to a clean domain, 301 redirect from the banned domain and hope for the best.

The content was indexed right away, but not the old rankings.

Medium term content indexed and no issues with scraper sites ranking above: why I added 301 redirects, was concerned 301's would pass the penalty (over ~9 months on, still OK).

Original domain was hit with unnatural link penalties (had the webmaster tool message).

Think I read Rand Fiskin had used the same approach for domains hit by Panda and had similar results. Though from memory his was for sites where they couldn't work out why the sites were downgraded, so a case of ran out of ways to try to recover rankings.

When I've done this I've also cleaned up any SEO issues, removed as many bad links as possible before the move (couldn't get them all) and went as whitehat as possible.

Not 100% recovery, but considering some of the rankings were due to links I removed, wouldn't expect full recovery.

The concern with not setting up the 301s is scraper sites, some of my content was years old and well scraped. I think if I hadn't added the 301's a scraper would have the SERPs (have regained many of the SERPs).
