Unsure if I have a spam penalty

Last year we received this message in Webmaster Tools:

Google has detected a pattern of artificial or unnatural links pointing to your site. Buying links or participating in link schemes in order to manipulate PageRank are violations of Google's Webmaster Guidelines.

So I asked an SEO guy to take a look and see if he could review our links and build and submit a Disavow file. His response that even though the message was there we are not actually receiving a penalty. However, over the years our site has tanked significantly in the SERPs.
Under Search Traffic > Manual Actions it says "No manual webspam actions found.".

So I'm still unsure if should spend time on money on Disavow. Is there a way to tell if we are being penalised?

    your website didnt received "manual penalty" but it dosent say he didnt received algorithm penalty...

    you probably received algorithm penalty and that why your website rank has dropped,

    analyze your incoming links and make a disavow link (it will take you time to gain ranking back as it dont effect immediately...)

    Only a penalty can cause your site to tank significantly. Build some backlinks, publish more content on your site, and disavow all spammy backlinks. Doing these will give your site a chance of recovery.
