Hyphenated.co.uk - but non hyphenated is on first page of google

The thing is their site is garbage and they have very few backlinks - it really shouldn't take too much work to knock them about.
I was just wondering if you think this would be a problem with the search engines, Legally (they could try and grab the domain) - but then again it is a generic phrase, so that would probably be quite difficult.
I know i could have gotten another name - but this is a well paying niche and these keywords are superb (over 10,000 searches per day) - also the seller let it go cheap so i couldn't pass it up.
I'm not to interested in it affecting re-sale value either.
