Potential Legal Issues With Competing EMD's?

If I have a domain, say chickenhens.net, and a chickenhens.com already exists, and chickenhens.com says "content and design produced by Niche Profit Sites", and chickenhens does not appear to be a registered trade mark (searched for at Trademarks Home) or actually company name or brand, could I potentially run into any legal or quasi-legal headaches if I use chickenhens.net as my own niche site? I would be planning to use original content and so forth, all 100% legitimate in that regard.
This relates to SEO I think it seems, so I'll post this here and hopefully, that is alright and appropriate. Thank you a trillion for any feedback in advanced.
