Depends if the image is copywrite by someone else and then yes, this can get you banned from Adsense.

I 2nd that.

OP, If the images are not in public domain & you didn't create them, you have no rights to them which is against Adsense TOS.

  Probably, but doing things that are known to be wrong just because everyone else does it, doesn't put money in the bank when Adsense does a manual review after getting a complaint from the owner of the image.

Thank Yukon and all the other posters. I'd admit, my OP was made with the view that it was not allowed but King mentioned, I see hundreds (if not most of them) completely violating this rule. While that doesnt make it right, how on earth is this not being addressed?

Because Google doesn't want to be in the middle of an argument, that & most people that own the stolen images probably never know they are being taken.

The problem is running into someone that takes their images very seriously, some people fight to the end on copyright content.

Well then you shouldn't use images you don't have permission to use. Personally I believe it's a negligible risk to use images (so long as they are low-value images, not images from a pro photog for example) but it is without question a risk. To be 101% clear, only use public domain images, images you've taken yourself or images from a free stock photo sites (being careful to follow the free licensing terms, such as attribution if required). I use stock.xchng for free-to-use stock photos (but remember free-to-use is not public domain)

Don't use Google images. A large percentage of them are copyrighted and a percentage of those have agencies that search the web for unauthorized use of those images.

Try Flickr (creative commons).
That's where I'm getting all my images from. Unlike Google images, they list clearly if you can use them or not and if you need to credit them.

For creative commons, you just use the image and put a link anywhere that leads to the author's flickr page.
Usually at the end of the article or under the image

example:
photo credit: authors name (linked to their flickr page)

Hey guys,

Thanks for your responses. I have started to replace my images (I have a ton so its going painfully slow). I am using 80% public domain images, ensuring that they are free to use and do not require attribution.

I have two questions with attribution with creative commons.

I am currently putting a small square arrow icon in the caption area (aligned right) with a hover over display when the visitor moves their mouse over it (in the title="") I list the original source of the image, the original authors name, his public profile (like on flickr) and a link to the creative commons license that I am using the share the image with). I also state that if this attribution is incorrect in any way, they can contact me via the contact form on my homepage or via the listed social media contacts.

1) Am I allowed to keep a copy of the image on my hosting account? (unless they explicitly say I cannot)

2) Is the attribution via hover-over sufficient?

I have decided to go with the completely safe option. I took a day or two and replaced ALL my images with copyright free AND "allowed for commercial use" (sometimes with attribution when required) images. I must say, I sleep better at night. I used Yoasts redirection plugin to redirect any old image urls that were no longer in use to ensure that there was no broken links. Most of my images where found using this:

I have a funny pictures website which probably violates tons of copyright laws when it comes to pictures. Worst case scenario is that I get an email with a take down notice in which I would just remove the pic... no biggie.

I believe you, but if you are using adsense there is always the chance that they may ban. To be honest, depending on your business objectives, this risk vs reward may be different and you may never even get in trouble. But personally, I would rather not take the risk. Thanks for your input though

Wrong, If your running Adsense.

If I find a site stealing my images (2,500+ images) & they're running Adsense, I'm reporting it to Adsense before I do anything else. If I'm doing that, I'm sure other people do the same. I could care less If someone stealing images has a contact email on their site, they read the Adsense TOS, If they didn't I could care less about that either, not my problem.

Not only do I agree with this but have done it as well. I also found for those who are hard headed, if I notify the host they will also shut down the website too. You can ignore those emails if you want too
