Links From Penalised Sites Harmful?

I have a website with some PR, but I also have another site in the exact niche. They are not linked in anyway, shape or form. However, the first site (which never actually made it to page one) got hit by penguin or panda or whatever. The second site actually outranked the first for most of the keywords.

Can I still put a sitewide or contextual link on my penalised site to my other site without hurting it? Considering the relevancy is like 100% I think it may help, but don't want to pass the penalty.

Any ideas?

If the site is not de-indexed you should be able to get away with it. Don't use a sitewide link though. Just a contextual link only on the front page would work best. Also, make sure that both sites are completely different with different content and are hosted on different IPs, different registrars, and different name servers.

Linking from a penalized site is a bad move. Penalized sites have had their trust score diminished so its not gonna do very much. Also since Penguin you don't want your backlink profile having links from sites deemed to be of low quality or spammy.

Don't risk it, if one site has a bad link profile and has been flagged as a SPAM domain, it's best to avoid the situation all together and not link any money sites from that domain.

  Getting links from sites that have been penalized is not worth the risk. A few quality backlinks from authoritative sources value more than hundreds of links from poor quality websites.

Don't take a link from the penalized sites because its harmful for your website where you may get huge affects on site ranking, page rank and traffics. So, Avoid contextual link from penalized sites.
