Should I Rank for a Trademarked Keyword?

This morning I got a email from a long follower of my seo blog and he wanted to know whether he should rank for a highly targeted "Trademarked Keyword"

Well I gave him my explanation on it through my blog but to take it a step further I wanted to know what you guys thought about it. Plus I will share you all's points of view with him which will allow him make a final decision.

i've been checking you out on the tube for over a year know. got a question. what if a keyword is trademarked. i'll be restarting my moving company that specialized in loading and unloading rental trucks and pods, just to name a few. The industry is coined "moving help." however, since being out of business for two years to rethink the biz, uhaul owner of movinghelp.com has trademarked the phrase "moving help," straight monopolizing the game.

however, i did notice how google knows scours your title, meta tags and body forming the keywords if not present. i want to run under the phrase "atlanta moving help," but this has their trademark in it. should i go for it by spacing or flipping the phrase like this, "get help moving in atlanta." it seems as if google is picking some sites up like this too. Dude, you should be the first to write on this, cuz more and more big companies are trademarking keywords and phrases.
