Hey everyone, recently i got removed from google search due to bogus dmca notice. I didnt get a notification at the host , only at webmaster tools that my URL's are removed from search results.

The website that filed the notice copied all my content on a new .info site and then hired a lawyer to send a dmca notice to google stating i copied the text from them. The website was 2 days old when it filed a complain and my site is 6 months old. i guess google didnt take a look at the 2 sites at all.

What can i do here , should i file a counter-complaint saying that i am the original owner of the text , or should i rewrite my content and then file a reconsideration request to google.

P.S. Anyone have a good lawyer i can consult about this and hire

So instead of investing money in their own content, the competition spent money on a lawyer?

Did you already try sending a reconsideration and state the above facts that it was them who copied you from the fact that their site is only 2 days old?

No i did not because i dont know if i should first file a counter-notice first or make a reconsideration request directly .

Wow i learnt a new trick of negative SEO. File a DMCA Notice , lol

This is ridiculous. You should have immediately sent google a reconsideration mentioning the facts that you stated above.

My guess is google nowadays is flooded with DMCA's and deindexes each one of them without investigating further. Again , people at google are full of nonsense.

i hired a DMCA agent that will send the counter-notice . Should i file a reconsideration request as well , that can take some time i think .

In the mean time i found out who was the one who sent the notice , and he is definitely keyword competitor , but he is from outside of US , i dont know if he can be held responsable for false dmca notice .

Remember, YOU WERE REMOVED from google search.
That is your ONLY PROBLEM! OK?

        Your site still lives.

Google will follow the advice of DMCA people.

I have submitted dates and when websites were created. It was
good enough to have the OTHER PARTY have their Google
site lose all copywrited material from search engines.

Let DMCA people do that, you can submit directly to Google if
you want. But since it is already a DMCA issue, Google will likely
        defer to that process.

File a reconsideration request and add a DMCA badge to all of your site's pages so he will not be able to do that thing again and again.

There is much, much more that
somebody is not telling us. I seriously doubt anyone hired
a lawyer. But it is very easy to tell. Just read on.

Google will restore your content if this really happened. It's
called a counter notification. Just google it.

You don't need a lawyer to file a DMCA with
        google or anyone else.

Age of site has nothing to do with anything.

I highly doubt you would have any luck suing them.

First, they didn't shutdown your website. They removed it from their index. It is not a right to be in their index. They can include and exclude anyone they choose to.

He would hire a lawyer to keep his name out of it , it think that is why.

Do you think i should file a reconsideration soon after i file a counter-notice , or to wait until counter notice clears the dispute.

you can send a counter notice, if you are sure that your content is original and done by you.
The counter notice to be addressed to Google. Don't spend money on lawyer, which is simply not required. If you are content owner, bogus takedown removed your listing, then file a counter notice. While writing counter notice, make sure that you give enough evidence to google that you are the owner and you own domain (in case), files and etc.

    Best of Luck.

Google is so busy now that they does not have a close look at any matter. They are removing a site without any prior notice, banning adsense without any notice. Also, if we apply for a reconsideration the response is always negative. Only a few 0.01% people had success in this way. So, google should be aware of these issues and should consider each and every points before making such ban or removal.

Google will not and does NOT want to be a judge!

File your own DMCA right freaking now!
Get OFF this forum until you get that done!
There is no better advice than this coming from
    this forum!

Explain to them, show them URL's
    Go to domainwhitepages.com
Show when their site and your site were created.

    Show other evidence of dates.
Techsmith has a product you can try
call Jing. It can copy portions of pages
and add text. Save and send to DMCA
    or Chilling Effects!

A lawyer would be really expensive!
You can do this on your own I am sure.
